This is to acknowledge receipt of your letter dated June 1, 1979, regarding ou-; November 17, 1978 letter.
We reviewed the information which you submitted as well as our files and concur with your finding that the verification requirement of 10 CFR 30.41(c) became effective on March 11, 1974. However, in 19!3, 10 CFR 30.34(c) permitted transfers of byproduct material to specific licensees "whose license authorizes him to receive such material."
From the above, we see that Purdue was not in violation of the verification requirement of 10 CFR 30.41(c) but did violate the requirement to transfer the two one-curie strontium-90 sealed sources only to an authorized recipient.
Therefore, the transfer sometime between April 10, 1973 and May 31, 1973 was in noncom-pliance with tiie regulations as they existed at that time.
It appears that portions of 10 CFR 30.34 were incorporated into 10 CFR 30.41.
Subsequent to the indicated transfer period, amendments to the Purdue and IUPUI licenses have rectified the matter of who is currently authorized to possess the two sources.
