The Staff is in receipt of a pleading entitled " TEX PIRG Amendments And Replies to Applicant and Staff to Conte:itions Submitted Pursuant to ALAB-535" filed in the captioned proceeding on June 15, 1979.

Pursuant to the permission granted it by this Board in its April 11, 1979 Order, TEXPIRG filed, on May 16, 1979, approximately fifty additional contentions in this proceeding which it sought to have admitted as issues in controversy.

Both the Staff and the Applicant filed responses to those contentions on May 31, 1979, and June 5, 1979, respectively.

TEXPIRG now seeks to reply to those responses and to amend certain contentions to attempt to cure the defects pointed out by both the Staff and the Applicant.

Of course, TEXPIRG has neither sought nor received leave of this Board to file its reply, and it has no right of reply pursuant to the Connission's regulations.

Therefore, unless requested to do sc by this Board, the Staff does not plan to file a response to TEXPIRG's June 15, 1979 pleading.
