NRC STAFF'S RESPONSE TO SKAGIT COUNTY'S PETITION FOR INTERVENTION AS AN INTERESTED COUNTY On June 5,1979, Skagit County filed a petition to intervene as an " interested county" pur-,. ant to the provisions of 10 CFR S 2.715(c)., Skagit County wishes to intervene in these proceedings without taking a position with respect to the issues. However,

it does request the opportunity to participate and to introduce evidence, interrogate witnesses and advise the Commission as provided by law.

NRC Staff has no objection to Skagit County participating in this proceeding under the provisions of 10 CFR S 2.715(c). However, the County should be advised at this time that it must take the proceeding as it finds it and must adhere to the hearing schedule establisned. There is nothing in the petition to indicate that Skagit County would have any problems with this condition.

344 148 In addition, we would note thc ) CFR S 2.715(c) authorizes the Board Chairman to require the representative of the interested county to " indicate with reasonable specificity, in advance of the hearing, the subject matters on which he desires to participate. " Such a requirement is appropriate in this case since the Applicants

. have indicated in their response dated June 7,1979, their understanding that Skagit County desires to participate on the issues of the delivery of reactor pressure vessels (RPV) by barge, and emergency evacuation plans. At this time the Staff does not intend to have witnesses on the RPV delivery impacts available for examination by the parties. This assessment was done by the Staff pursuant to a Board request --

it is not an issue in controversy in this proceeding. Thus, as indicated in its letter to the Licensing Board dated June 1,1979, unless a request is made by July 2, 1979, to have the RPV delivery witnesses available for examination, the Staff intends to offer only its written assessment into evidence. The Staff has contacted Skagit County about this matter and they have agreed to, examine the Staff's assessment on RPV delivery impacts and tell us on or around July 2.1979 whether they wish to have Staff witnesses available for examination. This arrangement is acceptable to the Staff if the Board grants this request for participation.
