N NRC STAFF'S RESPONSE TO APPLICANT 'S :.10 TION FOR LEAVE TO FILE OUT OF TE.iE On June 5,1979, Philadelpnia Electric Co.npany (PEC or Applicant) filed its " opposition" to Save Solanco Environment Conservation Fund's petition to terminate PEC's applica-tion for an early site review. Since PEC's opposition document was filed one day late, it was accompanied by a motion for leave to file out of time which set forth the reason for the late filing and recuested that the Licensing Board accept and consider the docu-ment despite its lateness.
In sicw of the fact that the Applicant's one-daf delay in filing its " opposition" will not delay this proceeding in any respect or result in any conceivable crejudice to part:es to the proceeding, the Staff does not opposa the.otion fcr leave to file out of time.
