NRC STAFF ANSWER T0" NOTICE OF PARTICIPATION BY STATE OF IOWA IN HEARING ON APPLICATION FOR 3
CONSTRUCTION PERMITS AND A REQUEST FOR EARLY SITE REVIEW" On May 3, 1979 the Nuclear Regulatory Commission (NRC) filed a " Notice of Hearing on Application for Construction Permits and a Request for Early Site Review."
44 Fed. R3 26229. That notice provided that any persons whose interests could be affected by the proceeding may file a petition to intervene by June 4, 1979.
In a pleading dated may 30, 1979, the State of Iowa made a timely request to participate as a interested state under 10 C.F.R. 62.715(c), reserving the right to interve.,e pursuant to 10 C.F.R. %2.714 if it lat'.r appears Iowa's interests muy be adversely affected by the proposed action.
The Staff ecknowledges Iowa's right to participate under 10 C.F.R. %2.715(c). Any petition to intervene pursuant to 10-C.F.R. 52.714, when and if filed, would be responded to by Staff on its merits.
