ORDER By motion dated April 27, 1979, the Regulatory Staff moved for sumary disposition of subparts (a), (b), (c) and (d) of Contention 2 submitted by the intervenor State of Illinois.
By stipulation of these two parties (which stipulation we hereby approve), 2(d) is withdrawn from this proceeding.
On the baeis of the pleadings, we determine that no genuine issue L
of material fact exists with respect to 2(b) and 2(c); hence, the Staff's motion for summary disposition is granted as to those contentions.
The motion is denied with respect to Contention 2(a).
