Toxic Pollutants Nothing in this pemit shall be construed to authorize the discharge of any toxic pollutant or combination of pollutants in amounts or concentrations which exceed any applicable toxic effluent standard or prohibition, including any schedule of compliance specified in any such effluent standard or prohibi-tion, prceulgated under Section 147.07(1), Wisconsin Statutes.

If a toxic effluent standard or prohibition, including any schedule of compliance specified in such effluent standard or prohibition, is pronalgated under Section 147.07(1), Wisconsin Statutes, for a toxic pollutant c-combination of pollutants which is present in the discharce and such standard or prohibition is trore strincent than any limitation for such pollutant in this cemit, this pemit shall be revised or codified in accordance with the toxic effluent standard or prchibition.

7 Civil and Criminal liability Except as provided in pemit conditions on "Bypassino" (Part I,23) and " Power Failures" (Part 1,24), nothing in this cemit shall be construed to relieve the semittee frca civil or criminal penalties under Section 147.21, Wisconsin Statutes, for noncompliance with the tems and conditions of this pemit.

Oil and Hazardcus Substance Liability Nothing in tnis pemit snall be construed to p'reclude the

or penalties to which the semittee is or may be subject under Section 311 of the Federal Water Pollution Control Act (33 U.S.C. Section 1321).

9.

State Laws Nothing in tnis pemit shall be construed to preclude the or penalties established pursuant to any other applicable State law or regula-tion.

10. Property Richts The issuance of tnis pemit does not convey any property richts in either real or personal property, or any exclusive privileges, nor does it authori:e any injury to private property or any invasion of perscnal rights, nor any infringe-ment of Federal, State or local laws or reculations.
11. Severability The provisions of this pemit are severable, and if any provision of this pemit, or the application of any provision of this remit to any circumstance, is held invalid, the apolication of such provision to other circumstances, and the remainder of this pemit, shall not be affected thereby.

12. Schedule of Caroliance Procross Rernrts No later than 14 calendar days followinc a date identified in any schedule of compliance in Part II, the pemittee shall sobrit either a report of procress or, in the case of specific actions beinc reouired by identified dates, a written notice of ccmpliance or noncompl Rrce.

In the latter case, the notice shall include the cause of noncoroliance,.iny reredial actions taken, and the I

probability of reeting the next scheduleo requireeents.

13. Test Procedures Test procedures used for the analysis of pollutants shall be those listed in Chapter 1:R 219, Wisconsin Administrative Code, or an alternate method authorized in Part II.
14. Recordinc of Results For each reasurerent or sample taken pursuant to the recuirerents cf this pemit, the pemittee shall record the follcwine inforration:

a.

The exact place, date, and tire of sarolina; b.

The dates the analyses were perfor ed; c.

The person (s) who performed the analyses; d.

The analytical technioues or methods used; and e.

The results of all required analyses.

15. Additional Ponitorino by Permittee if tne pemittee conitors any pollutant at the location (s) designated herein more frequently than required by this cerrit, usino approved analytical methods as scecified in Chacter NR 219, the results of such ronitorina shall be included in the Discharce Monitoring Report Form 32C0-28.

Such increased frequency shall also be indicated.

16. Pecords Retention All records and information resulting free the monitoring activities r::uired by this permit including all records of analyses perforred and calibration and raintenance of instrumentation and recordincs fron continuous monitorinc instru-centation shall be retained for a minirun of three (3) years, or larger if requested by the Cepartment of Natural Resources.
17. Construction of Onshore or Offshore Structures This perrit cces not authorize er approve the censtruction of any onshore or offshore physical structure of facilities or the undertakina of any work in any navigable waters.
18. Confidential Information Except for data detemineo to be confidential under Section 147.08(2)(c). Wisconsin Statutes, all monitoring reports required by this pemit shall be available for public inspecticn at the headquarters of U.S. EPA Recion V and the Department of Natural Resources. Knowingly making any false statement on any such rexrt ray result in the imposition of criminal penalties as provided for in Section 147.21, Wisconsin Statutes.
19. Transfer of Control of Goeration In the event of a transfer of control of operation of the facility fren which the semitted discharces emanate to a person not named on pace one (1) of this pemit, the pemittee prior to such transfer shall notify his successor by letter that this permit is not transferable and that prior to any discharge af ter such transfer, a new WPCES pemit rust be obtained. A cony of this letter shall be forwarded to the Departrent of Natural Pesources, WPCES Pemit Section, Cox 450, Madison,',isconsin 53701.

20. Change in Discharce Any anticipated facility expansions, production increases or process modifications which will result in new, different, or increased discharges of pollutants must be reported in accordance with Chapter NR 200, Wisconsin Administrative Code, by submission of a new WPDES arolication or, if such changes will not exceed the effluent limitations specified in this oemit, by notice to the Department of Natural Pesources of such changes.

21. Noncoroliance Notification If, for any reason, tne pemittee dces not ccroly with or will be unable to comply with any daily maximum effluent limitation specified in this pemit, ne shall provide the Departrent of Natural Resources in writina within five (5) days of becoming aware of such condition, with the followinc 1hation.
a. A description of the discharce and cause of nonccmpliance; and
b. An identification of the ceriod of ncnccroliance, includino exact dates and tines; or, if centinuing, the anticicated tire the noncoreliance is expected to continue, and a description of the steps beine taken to reduce, eliminate and prevent recurrence of the nonccepliance.
22. Facilities Operation The gemittee snal' at all tires raintain in cced workinc order and operate as efficiently as possible all treatrent or control facilities or systers installed or used by the pemittee to achieve tcmoliance with the terns and conditions of this pemit.

23. 24. Pcwer Failures In order to maintain compliance with the effluert liritations and prohibitions of this remit in the event of the reductier, inss, er failure of cne or nere of the primary sources of ccwer to the wastrvater control facilities, the pe mittee shall either:

25. Definition Terms (i) For those terms used in Parts I and II which are defined in Se 147.015 Wisconsin Statutes, the meanings of that Section shall apply.

(ii) As used in Daily Effluent Limitations, Part IT:

(1) " Average" means the arithmetic mean of daily monitoring test resu obtained during a cciendar month for the given parameter;. that is liter, or other appropriate unit divided by' the num which results are totaled.

Data collected by the study shall be sumarized every three ronths in reports postrarked no later than the 28th day of the nonth following the corpleted reportino period.

Sarolinn Reauirments Unless specified othersise herein, samples shall be taken in accordance with Chapter NR 218 of the Wisconsin Adninistrative Code.

Monitoring reportr and reports required by Sections 12, 20, 21, and 23 of Part 1 of this pemit shall be signed; (1) for a corporation by a principal executive officer of at least the level of Vice President or his duly authorized representative having overall respcnsibility for the operation of the facility for which this permit is issued, (2) for a partnership by a c;neral partner, and (3) for a sole proprietorship by the proprietor, except that (4) in the case of reports required by Sections 21 and 23 the individual required to sign in accordance with this subsection ray authorize another individual to sign such reports in his absence.
