This is in response to your letters of February 13, March 23 and 29,1979, and in reference to your discussions with Material Control & Accountability Licensing Branch personnel during meetings held at I!RC ';eadquarters April 16-18, 1979.

The correspondence and conversations relate to your request for interim relief fron the requirement of 10 CFR 70.58(i)(2) which limits tbs accumulation of scrap measured with an uncertainty greater than i 10 percent.

We have determined that your request for interim relief from the requirements of 10 CFR 70.58(i)(2) to July 31, 1980, for the material described in your referenced letters, will not endanger the common defense and security and ;

otherwise in the public interest.

Accordingly, new License Condition 7.8 is added to Amendment SG-4 to your License t;o. SNM-1107 to read as follows:

7.8 "i;otw thstanding the requirements of 10 CFR 70.58(i)(2), the licensee i

may accumulate and store low enriched uranium scrap as described in hit letters dated February 13, March 23 and 29,1979 which has a me asurement uncertainty greater than i 103 for a period of time not tt exceed one year or July 31, 1980, whichever is greater.

The li:ensee shall also follow all the procedures described in the referenced documents."

In addition to new License Condition 7.8, any scrap generated after the effective implementation date (May 30,1979) of your Measurement Control Plan shall be subject to License Condition 4.2.

Consistent with the requirements of License Condition 4.2, an evaluation of the adequacy of the sanpling procedures for scrap generated a f ter the effective date of the Measurement Control Plan must be given precedence based on the potential impact of the material on the inventory difference.

Documentation of this data must be maintained and made available to the fiRC upon request.

- Prior to start-up of the new scrap recovery process, Westinghouse-Columbia cust submit for our review and approval revised pages to the Plans required by 10 CFR 70.51, 70.57 and 70.58.

Our telephone conversations with Mr. Harold Foster and Mr. R. DiPiazza, License Administrator, Pittsburgh, PA confirms that the attachment to Mr. R. DiPiazza's letter of February 13, 1979 and Mr. H. Foster's telecopies and letters dated March 23 and 29,1979 contain information of a type specified in 10 CFR 2.790(d). Accordingly, pursuant to Sec tion 2.790(d)(1),

such information is deemed to be commercial or financi l information within a

the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
