Dear Ms. Weiss:

This is in response to your letter of March 19, 1979, in which you requested, pursuant to the Freedom of Information Act, copies of records concerning Task Action Plans A-40 and A-41, documents written by H. R.

Denton and Carl Stepp, records concerning seismic issues, and inspection reports for the Beaver Valley units.

The following paragraphs respond to the numbered items in your request:

1. and 2.

There are approximately 4 shelf feet of records prepared, compiled, and gathered by NRC in connection with Task Action Plan A-40, which are subject to your reques t.

There are only a few documents pertaining to Task Action Plan A-41, because it has been canceled.

We are prepared to make the records for both task action plans available for your inspection at the office of the NRC's Division of Reactor Safety Research, Office of Nuclear Regulatory Research, which is located at 7915 Eastern Avenue, Silver Spring, Maryland.

Since some of the documents are in current use by NRC j

staff, you should make advance arrangements with 11r.

Goutam Bagchi (Phone: 301-427-4445), in order to assure that the documents will be available at the time you wish to review them.

3. and 4.

Documents written by H. R. Denton and Carl Stepp containing discussion of seismic issues are, in response to your request, being placed in NRC's Public Document Room (PDR), located at 1717 H Street, N.W., Washington, D.C.

With respect to these items, we have construed your request to pertain only to documents written since January 1,1977.

Seismic documents covering the five-year period 1972-1976 were released in response to an earlier F0IA request made by the Union of Concerned Scientists.

These documents are already in the PDR, filed under FOIA-76-261, in the name of George C. Deptula, and an index of them is available at the PDR.

l Denton are also being made available at the PDR in response to your request.

We have excluded from the scope of the request records that relate to purely administrative or personnel matters.

Documents containing information on seismic issues prepared for or compiled in the course of the Systematic Evaluation Program are also being placed in the PDR.

There is one document v.hich is still undergoing review.

As soon as the review is completed, we will advise you regarding our disclosure determination.

7.

Inspection reports for the Beaver Valley units, with the exception of dc,cuments relating to physical security of the facilities, are also available in the FDR.

They are filed in docket files 50-334 (Unit I) and 50-412 (Unit II),

All inspection reports for the Beaver Valley units.

UCS requests that NRC waive any fees.

Disclosure to UCS meets the standard for waiver of fees, being "in the public interest because furnishing the information can be considered as primarily benefiting the general public."

5 USC S552 (a) (4) (A).

As you know, UCS is a non-profit public interest group with a long-standing interest and established expertise on issues of nuclear safety.

If this request for waiver of fees is denied, you are authorized to incur up to $100.00 in costs.

If the costs exceed $100.00, we request to be given access to the materials so that we can deter-mine which documents to copy.
