Dear Mr. Kranish:

This is in response to your letter dated April 3,1979, appealing Mr.

Joseph M. Felton's fiarch 13, 1979 initial denial-in-part of your Freedom of Information Act request of May 25, 1977.

That request sought access to all correspondence, memoranda, reports, and other records received, considered, or approved by the Task Force on Allegations by James Conran.

Your appeal excluded statistical and numerical data.

Acting on your appeal, documents 7 and 9 have been carefully reviewed and it has been determined that additional portions of these documents car now be released.

Enclosed are the pages which contain the additional i n forma tion.

It also has been determined that he remaining portions of these documents continue to be exempt from disclosure under the Freedom of Information Act.

Portions of document 7 contain Restricted Data and National Security Information and are exempt from disclosure pursuant to exemptions (1) and (3) of the Freedom of Information Act (5 U.S.C. 552(b)(1) and (3))

and 10 CFR 9.5(a)(1) and (3) of the Commission's regulations.

Portions of document 9 contain National Security Information and are classified pursuant to Executive Order 12065 and are being withheld from public disclosure pursuant to exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1) of the Commission's regulations.

Your appeal with regard to the remaining portions of documents 7 and 9 is, therefore, denied.

This determination is a final agency action.

As set forth in the Freedom of Information Act (5 U.S C. 552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in either the district in which you reside, have your principal place of business or in the District of Columbia.
