EXECUTIVE BRANCH RESPONSE, DATED JUNE 11, 1979, ON PENDING EXPORT APPLICATION OF LEU TO REPUBLIC 0F KOREA, XSNM01472, SECY-79-182

Purpose:

To inform the Commission of the above subject.

Discussion:

Encle3ed for the information of the Commission are copies of the Exe utive Branch response on a pending application to export low-enriched uranium for the KORI 2 reactor, Republic of Korea.

Copies of the Executive Branch comments have been placed in the Public Occument Room. A Commission Action Paper will be forwarded soon.

As this proposed export of fuel is for the initial core and 40 reloads for a period in excess of 40 years, we requested the views of the Department 3 State and other interested agencies on what Solicy the Executive Branch has adopted concerning the number of reloads which may be approved and for what period of time.

For this p oposed export, the Executive branch view is to approve only the iritial core plus 3 reloads for a. period of 5 years. This view, hovever, does not represent the overall policy of the Executive Braach concerning the question of multiple reloads.

At the June 8 inte agency SNEC meeting, it was decided that at the present time each application involving multiple reloads must be reviewed on its own merits.

Commissioners are requested to advise the staff of any particular issues or information which they can identify at this stage and which they wish included _in the staff's analysis.

Dear Mr. Shea:

This letter is in response to your letter dated March 14, 1979, requesting Executive Branch views as to whether issuance of an export licence in accor-dance with the application hereinafter described would be inimical to the common defense and security of the United States and whether the proposed export meets the applicable criteria of the Atomic Energy Act of 1954, as amended by the Nuclear Non-Proliferation Act of 1978:

NRC No. XSNM01472 -- Application by the Westinghouse Electric Corporation for authorization to export to the Republic of Korea 25,005 kilograms of U-235 con-tained in 727,175 kilograms of uranium enriched to a maximum of 3.5 percent.

This low enriched uranium in the form of fabricated fuel assemblies is intended for the initial core plus 40 reloads for the Kori 2 Nuclear Power Plant, in Korea.

The proposed export would take place pursuant to the Agreement for Cooperation Between the United States and Korea as confirmed in a letter from the Embassy of Korea, a copy of which is enclosed.

Korea has adhered to the provisions of its Agreement for Cooperation with the United States.

The Executive Branch has reviewed this application and concluded that the requirements of the Atomic Energy Act and P.L.95-242 have been met and that the proposed 3

. export will not be inimical to the common defense and security of the United States, provided that the validity of the license be limited to five years and the quantity of fuel limited to an initial core, essential spares and three reloads.

A detailed analysis for Korea was sub-mitted February 23, 1979 for NRC application No. XUO8436.

There has been no material change in circumstances since that subnission.

On the basis of the foregoing, the Executive Branch recommends that the license be issued.
