Gentlemen:

This is the report of discovery activities by the Public Utilities Board of the City of Brownsville, Texas (" PUB") for the month of May, 1979.

During the month, PUB worked with Houston Lighting &

Power ("HL&P") to provide additional information responsive to HL&P's interrogatories and document requests to PUB.

"UB counsel travelled to Shreveport, Louisiana to inspect and copy documents produced by Southwestern Electric Power Company, one of the sister companies of Central Power and Light Company ("CP&L"). PUB has been in contact with CP&L counsel, and expects to travel to Central and South West Gervices, Inc. and Central and South West Corporation (Dallas, Texas); West Texas Utilities, Inc. (Abilene, Texas);

to inspect documents, which were requested in March, as soon as CP&L attorneys have screened document production in those three locations.

PUB has worked with Texas Utili.ies ("TU") counsel on the details of TU compliance with the PUB document request filed on January 31, 1979, and is making final arrangements prior to reviewing the documents.

On the matter of the subpoena duces tecum iseued to Gulf States Utilities on PUB'a application, PUB spent much of the first part of May preparirg its Answer to GSU's Motion for a Protective Order and Selling Conditions for Compliance, filed April 25, 1979. PUB's Answer was filed on May 10.

Argument on GSU's Motion regarding the subpoena was held on June 1, 1979 at a prehearing conference. As rcquested by the Board, PUB infor.aed GSU o f the Board's rulings a' that con-ference requiring it to comply with the full subpoena on June 18, 1979, and denying GSU's motion to recover costs of compliance from PUB.
