Docket Nos. 50-498 and 50-499 j
Gentlemen:
In accordance with the Staff's letter to the Atomic Safety and Licensing Board (the Board) of May 29, 1979, and the Board's June 8,1979, riemorandum and Order, the Staff sebmits its report on the status of discussions and negotiations on the contentions of the Intervenors in this proceedir.g.
Subsequent to the Staff's May 29, 1979, letter to the Board reporting on the status of negotiations as of that date, the Staff received pleadings from both Intervenors and from the Applicants.
Under cover of a letter dated May 24, 1979, Citizens Concerned About Nuclear Power (CCANP) filed reformulated versions of the two contentions found by the Board to be accept-able.
On May 29, 1979, Citizens for Equitable Utilities, Inc. (CEU) filed a " Supplement to Citizens for Equitable Utilities Origir.al Petition," which sets forth CEU's reformulated contentions and information regarding these contentions.
In a letter to the Board dated June 5, 1979, the Applica.1ts responded to the Staff's May 29 letter and transmitted the Applicants' response to the above-mentioned pleadings of the Intervenors.
Based on the foregoing filings, which reflect substantial changes in position on a number of contentions from those taken at our meeting, the Staff con-cluded that further negotiations would not be likely to lead to a stipulation on contentions.
The Staff did contact the Intervenors by telephone to seek clarification of their positions and to aid the Staff in its evaluation of their revised contentions.
Based on the Staff's consideration of the revised contentions, the Staff has provided, in an attachment to this letter, a state-ment of position on these contentions.
In its June 8 Memorandum and Order, the Board requested that the Staff provide information regarding the proposed issuance dates of the principal Staff docu-ments related to the South Texas Project.
In this regard, we wish to advise 7 90808 con
