Dear Mr. Denton:
1 am writing on behalf of The Cleveland Electric Illuminating Company ("CLI") with reference to your Order of June 25, 1979 calling for,odification of Mtitrust License Condition '!o.

That Order, as ended on July 16, li'9, directs CEI to file with the Federal Uncrgy Wgulatory C c:~. i s s i o n (' F ERC") certain a'7e ndm e n t s to CEI's transnission service tariff.
By its terms, the Order in to take effect imed ia tely.
CEI intends to make a timely request for an opportunity to be heard on nattm cet forth in the June 25 Order and the attachments thereto.
The purpose of this lecter, hcwaer, is to request recon-sideration of your Order insofar as it is intended tu become eifective mTmd 2 a te ly.

Denton August 2, 1979 Page Two pursuant to the Order here, a number of contested issues being con-sidered in the F"RC appeal will be mooted by that fil.ng.
As a con-sequence, CEI will be unfairly deprived of a meaningful opportunity to exercise both its appeal rights at FERC and its hearing righcs before the Nuclear Regulat ry Coramission prior to the filing of a transmission service tariff which it legitimately believes to be objectionable in several important respects.
In order to avoid such a result -- which would not, in our view, comport witn the directive contained in Antitrust License Condition No. 10* -- CEI hereby requests a modification to the "im-mediate effectivencas" aspect of the June 25 Order.
We ask that the effective date of that Order, as extended, be further amended to follow by twenty-five (25) days the effective date of the final opinion and order by tne Federal Energy Regulatory Commission in FERC Docket No. ER 78-194.
The granting of this requnst will perr.it the orderly com-plotion of CEI's appeal currently pending at FERC without causing any prejudice to other interested parties.
