In your letter of April 20, 1979, yot. raised the question of the applicability cf Criteria VII and XVIII of Appendix 3 to 10 CFR 50 by the purciaser to the cctivities of the AS!1E Authorized Nuclear Inspector.
Uc are in general agreement with the position that General Electric has taken on this matter.
It is the staff's position that compliance to Criterion VII of /ppendix B relative to source evaluation and selection by the purchaser of code inspection acrvices from an Authorized Inspection Agency, which is the organi.:ation that provides tho Authorized Nuclear Insper ' ors, should not be required because it would tend to detract from the necer try independence of the AI As and ANIS from the purchaser of such services.

having ASME Certificates of Authorization (Code-Stamp holders).
In addition, ccmpliance to Criterion XVIII of /gpendix 3 relative to auditing by the purchasar of ccde inspection services fmni an AIA should also not be required for the same reason indicated above. We are considering the advis-ability of recomending that the National Board of Boiler and Pressure Vessel Inspectcrs pcrfom such audits.
