Thanks for chasing down this piece of information. This will assist us in completing our SUNSI review of your Revision 2 submittal.

Although I dont think you need do anything further regarding this figure, I would suggest that the statement be removed from the figure in case that particular figure needs to be submitted in the future (e.g., as part of an RAI response).

Also, fyi, John Nguyen has returned from vacation, and you can direct any future questions about this issue to him.

Allen I have chased down the story behind ER Figure 3.5-1. The figure and information belongs to Waste Control Specialists (WCS) and at one time this information was held in Confidence by WCS, but this was prior to the work on the CISF. As I noted in an earlier email, the figure has been included in all three revisions of the ER (Rev 0, Rev 1 and Rev 2) and has been available on ADAMs to the public for more than a year now. In addition, there is at least one copy in a public library in West Texas. Finally, this figure is not included in the Affidavits provided with our submittal, because the Figure is no longer being held in Confidence by WCS. Therefore, the information may continue to be made public in Revision 2 of the ER.

Thank you for bringing this to our attention and giving us the opportunity to verify that the figure should not have been included in our Affidavit and redacted from the ER.

If there is any further action required on our part related to this matter, please let me know so that we can take the required actions.

John and Jim, Just a heads up that the applicant labeled WCS CISF ER, Rev. 2, Figure 3.5-1, NDD Elements of Occurrence, as Not for Public Disclosure. The file is named 030 PUBLIC Enc 3 ER Rev 2 02 of 09 Ch 3.pdf I noticed that an earlier version (ML16133A141) is publicly available and also has this mark on the same Figure.
