REPORT OF THE DEPARTMENT OF JUSTICE - May, 1979 Pursuant to the order dated June 21, 1978, issuci by the Atomic Safety and Licensing Board

(" Board"), the Dapart-ment of Justice ("Jepartment") submits this report on the progress made by the Jepartment in implementing discovery during the month of May, 1979.

During the month of May, the Department reviewed supplementary incerrogatory answers and documents produced by Houston Lighting and Power Company ("HL&P") and Texas Utilities Generating Company ("TUGCO") in answer to the Department's initial interrogatories and document requests filed last November.

These supplementary answers and documents were produced, following meetings among counsel, in response to Board orders issued March 6, 9 and 12, 1979.

The Department has been in contact with attor.eys for both HL&P and TUGCO since reviewing their supplementary productions and is still awaiting compliance on a few outstanding 519 013 7907180 0 4 0

matters.

However, the Department is confident that the small issues whien remain with respect to the Department's first discovery requests can now finally be resolved withont further problem or delay.

On May 11, 1979, the Department filed an answer to the motions of Gulf States Utilities Company ("GSU") for a protective order and for an order setting conditions for compliance with thc subpoena served on it by the City of Brownsville ("Brownsville").

The Department, as expressed in its answer, is concerned about the long delay which has surrounded compliance with the GSU subpoena.

The Depar tment has arranged to review whatever docurcents are produced to Brownsville.

It had hoped to complete that task long before now.

On May 17-18, 1979, the Depar tment reviewed documents in the possession of the Southwestern Electric Power Company

("SWEPCO"), one of the Central and Southwest ("CSW") compan-ies.

On May 29-31, 1979, the Department examined documents at the headquarters of Central Power and Light Company

("CP&L").

Additionally, the Depar tment is in the process cf arranging to examine documents at West Texas Utilities

("WTU").

The Department has also been involved in discussions with couns31 for HL&P regarding the reciprocal exchange of prior testimony of individuals named as expert witnesses in these proceedings. 519 014

In addition to the foregoing, the Department has been continuing both its field work and the review of documents already in its possession.
