SUMMARY

OF AUGUST 19, 2019, PARTIALLY CLOSED PUBLIC MEETING WITH HOLTEC INTERNATIONAL TO DISCUSS PRE-APPLICATION OF THERMAL TOPICAL REPORT On August 19, 2019, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and Holtec International (Holtec, the applicant). The purpose of the meeting was to discuss Holtecs plans for submittal of a Thermal Topical Report for allowance of candidate heat load patterns without an amendment request. The meeting notice and agenda, dated July 31, 2019, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML19212A763. During the meeting, the applicant presented slides, which are available at ADAMS Accession No. ML19212A455. The enclosure to this document contains the meeting attendance list.

After introductions, NRC managment made the following opening remarks: 1) Topical Reports are common in other parts of the agency, but they are not typical in the Division of Spent Fuel Management, 2) the Topical Report is not a substitute or replacement for the required licensing action (e.g, amendment, exemption, etc.), 3) there will be a need to discuss further how the Topical Report would be incorporated.

The applicant discussed how they plan to propose a suitable methodology permitting licensee qualification of candidate heat load patterns without the need for a license or Certificate of Compliance amendment. It is the applicants intent that the Topical Report would receive NRC approval, and that the approved methodology would allow Holtec, and its clients, to address emerging plant needs in a timely manner. Holtec stated that an approved Topical Report would prevent future undue engagement of regulatory resources by requiring fewer amendment submissions, and that some previous amendment applications would have essentially not been needed if the approved methodology was already in place.

C. Regan Most of the discussions were associated with questions (Q) from NRC staff and the public.

Holtec attempted to answer (A) as many of these questions as possible. However, Holtec stated that the details of this application were still being worked out internally. Some of the key Q&As regarding this pre-application are discussed below:

  • Q: NRC staff asked when the Topical Report would be submitted? A: Holtec stated, early next year, maybe within the next 6 months.
  • Q: NRC staff and the public asked how the Topical Report will address concerns regarding the effects of decay heat on other disciplines? The scope of the Topical Report was unclear. A: Holtec stated that they intend to stop referring to this application as a Thermal Topical Report and more simply state it as a Topical Report, because they do plan to address the effects on other disciplines such as shielding, criticality, structural, etc.
  • Q: NRC staff and the public asked questions trying to understand the parameters of the Topical Report (e.g., limits on heat load, bounding parameters, etc.)? There were concerns that the Topical Report appeared to be opened ended, and it was not clear if the Topical Report would place any limits on total heat load or a per assembly basis.

A: Holtec stated that these details had not been fully worked out yet, but that some limit/bounds will be proposed.

  • Q: NRC staff asked if the Topical Report would be submitted separately or as part of an amendment? A: Holtec indicated that the Topical Report would be submitted separately, and if approved, then Holtec would submit a separate amendment request at some future date to incorporate the Topical Report.
  • Q: NRC staff was not clear on which regulations Holtec is trying to meet with this Topical Report? A: Holtec indicated they would provide those details in the application.

No regulatory decisions were made during the meeting. Several members of the public attended the meeting and asked questions. Some of the publics questions were similar in nature to NRC staffs questions reqarding the envelope or boundaries of the Topical Report.

There were also some additional concerns (e.g., transportation, retrievability, consolidated interim storage applications) raised by the public that were out of scope for this meeting.

Holtec is planning to request another pre-application meeting prior to their official submittal.

Holtec indicated they may try to schedule the next meeting with the NRC before the end of calendar year 2019.
