N %I (_ cv& EEFORE THE ATOMIC SAFETY AND LICENSING BOARD IN THE MATTER OF: ) ) Docket Nos. 50-295 COMMONWEALTH EDISON CCMFANY ) 50-304 (Zion Station Units 1 and 2) ) MOTION IN REGARD TO SCHEDULING OF M HEARING TO BE HELD IN Z I O';., ILLINOIS ' JUNE 11-23, 1979 The STATE OF ILLINOIS (Intervencr) is. in agree =ent with both the Cc=monwealth Edison Ccmpany (Applicant) and the staff of the Nuclear Regulatory Commission (Staff) that the ASLB should determine, p:.icr to the opening of the hearing in this case, a schedule for the presentation of testimony. The schedule presented by the Staff is in principle acceptable to the Intervenor with the exceptions noted below. Intervenor therefore moves that the Board prepare a schedule for the conduct of the hearing and the presentation of evidence in the above captioned proceedings ta.~cing into consideration the following:
- 1. The Intervenor withdraws centention 2 (m).
- 2. The Intervenor 's witness and consultant on the issues of corrosien and degradation of Scral, renitoring and accident scenarios, Mr. Gregory C. Minor will not be available until the af terncon of Thursday, June 14, 1979. Therefore Intervenor w:.ll not be able to aderuately and effectively conduct cross examination in -hese reas,

For the Board to schedule testimony on any of the areas =entioned above prior to Mr. Minor's arrival on June 14, 1979 would constitute severe hardship and prejudice to the Intervenor. Ecwever, the Intervenor is willing to deal with these issues the afterncon of June 14, and all day June 15. Intervenor is ale o willing to continue the Thursday and Friday sessions into ths evening hours; and if necessary Intervenor will make its witness available en Saturday, June 16, 1979.
- 3. According to agreement with the Applicant and Staff, the Interveno::'s witness and consultant on spent fuel boiling, Dr.
Marvin Resnikoff will be available on Wednesday, June 20, 1979. Therefore contention 2 (g) can most conveniently be scheduled on that date. 4. Intervenor's witness and consultant on Board question 4(b), Mr. Peter Claary, will be at Cicn on Tuesday, June 12, 1979 to act as consultant to Intervenor in regard to contention 2 (a).

. June 11 and 12, 1979. The issues addressed by contention 4(b) are of particular intr. rest to citizens who will be attending this public hearing. As it is impossible to predict' in advance the time it will take to pursue each of the issucs in the hearing, the nost ef fective way to guarantee that the citizens and residents of the Zion area will be able to attend that part of the hearing which will deal with this issue of vital interest to them is to schedule 4(b) at the beginning of the proceedings. 5. Intervenor requests the Board to include in its schedule sufficient time for each of the partias to make a brief opening state-. ment. As many members of the public will be present, and as few, if any, of these cbservers will have had an opportunity to review the prefiled testimony and pleadings, an opening statement from each of the parties can serve to enunciate the position of each of the parties for the public. This will make public participation a more meaningful experience, as en'zisioned by the Atomic Energy Act. Opening statements will also clarify for the Board the direction each of the parties intends to take in pursuing its cross examination of witnesses. Intervenor suggests the following schedule: Monday - June 11, 1979. _4 Wednesday - June 13, 1979: Centention 2 (1) Centention 2(n): review of procedure for installation of spent fuel racks to determine whether the procedure has been changed since the filing of the affidavit addressing this contention and whether the existing procedure will achieve ALARA. Argument to support Intervenor's request that an appropriate license concition is necessary (per Board ORDER of May 1, 1979) Thursday -June 14, 1979 : Morning session: Conglete testi=cny on above content-ions. Afternoon session: Contentions 2 (e) 2 (h), 2(i), 2(j) Friday - June 15, 1979 Contentions 2(e), 2(h), 2(i), 2(j) Saturday-June 16, 1979 : Contentions 2 (e), 2(h), 2(i), 2(j) (at Boa r.1 discreti.on) Wednesday-June 20, 1979 - Saturday, June 23, 1979: With the exception of Board question 4 (b), which should be heard on Tuesday, June 12, 1979 for the edification of the p ub lic, Intervenor concurs in the second week schedule as presented by the Staff in its Motion.
