1979, we are enclosing our check in the ar. unt of $4,000 in payment of the fee required for the contingency plan submitted with Amendments Nos. 2 and 3 to the Modified Amended Security Plan (MASP) submitted by the District on May 10, 1978 and October 3, 1978, pursuant to 10 CFR 50.34(d) and 73. 40 (b) of the Comission 's regulations, for Rancho Seco Nuclear Generating Station.

The enclosed license fee is paid under protest since a lawsuit is on file in the United States Court of Appeal for the 5th Circuit (Mississippi Power & Ligne Co.,

et al. vs. United States Nuclear Regulatory Com-mission, et al.

Civ. No. 75-1565) to obtain review of the validity of those rules.
