Dear Mr. Grossman:
This is in response to your letter dated May 22, 1979 to Chaisman Hendrie in which you requested, pursuant to the Freedom of Information Act, the Stone and kl : >ter Engivering Company's " Design Coordination Reports" which relate to construction of the Shorehm Nuclear Power Station.
Specifically, you requested access to sorae 17,000 to 1E,000.uch repor ts which the Long Island Lighting Co keeps at the Shoreham site.
The Freedom of Information Act (FOI A) and NRC's regulations apply only to records in the possession of the NRC.
As you indicat_d in your letter the records requested are the property of Long Island Lighting Company and are maintained on the Shoreham site.
Those records are available for review by NRC inspectors, bit copies are not in possession of NRC.
Therefore, since they are not agency records subject to public access under provisions of the FOIA, the NRC is unable to provide you access to them.
