FOR ADDITIONAL 'IME On May 8,1979, the NRC Staff filed an "* *

  • Interim Response to County of Suffolk's Motion for Leave to F. e o Supplemental Brief and Request for Addi-tional Time."

In that filing the Appeal Board was advised that the Staff is in the process of evaluating infocmation developed from the accident at Three Mile Island to determine what, if any, relcvance this information may have to the pr esent proceeding.

In additior., the Appeal Board was advised that the Staff is also reviewing the complete record in this proceeding to determine if any of the testimony and documents previously filed herein should be oupple-mented or modific.d in light of the information being gained from the TMI experience.

'Jhile the task involved is substantial, it was anticipated at the time thc Staff's filing was n ade that the evaluation would be completed within the relatively near future. However, to date, that review has not yet been completed and it is anticipated that still additional time will be required for its ultimate completion.

_2 Cecause.the Staff remains persuaded that the interests of the parties, as well as the Board, are best served by awaiting the completion of the Staff's ongoing evaluation and the subaission of the acquired information to this Board and the parties, the Staff requests that its time to respond to the pending motion be extended until it has completed its review of this matter.

For with the additional information obtained as a result of this review, the Staff believes Y

that it will be ablve to specificai',y address the issues raised in the County s motion and respond to those matters in a more informed and responsive manner.

The Staff will, of course, keep the Board and the parties informed of the progress and expected completion date of this inquiry.

Conclusion For the reasons stated above, the Staff requests that the Appeal Board extend and enlarge the time for the Staff to respond to the pending motion until such time as the Staff's review of this matter has been completed.
