This responds to your letter dated !!ay 11, 1979 in which you requested, pursuant to the Freedom of Information Act, records regarding fiRC's policies governing waiver of search and copying fees for documents requested under the Freedom of Information Act.

The U.S. T'uclear Regulatory Commission (iiRC) has not charged fees for search during period 1974 to the present.

f:RC routinely providcs public access to its records at the i,RC Public Document Room (PDR),1717 H Street, 11.W., Washington, D.C. and at its Local Public Document Rooms (LPDR's) which are located in the vicinity of major nuclear facilities which are licensed by I;RC.

At those locations, requesters can inspect the records and, through a private contractor at the PDR or through the facilities which house the LPDR collections, purchase a copy of the records.

The practice has now been codified in 10 CFR 9.14, which became an effective rule en April 16, 1979.

Periodically, requesters have paid the higher agtocy charge of $.10 per page rather than purchase just those records in which they are interested at $.08 per page from the PDR contractor.

The enclosed docur;ents relate to NRC procedures and policies which became effective on April 16, 1979.

Prior to that date f1RC had included in 10 CFR Part 9, a procedurai rule granting the right to request a waiver or reduction of fees and, if denied, the right to appeal.
