A3S":2ACT The Metropolitan Edison Co=pany and Jersey Central Power L Light Ccapany, co-owners, have requested an exemption from provisions of 10 CFR 50.10(b) to install the tendon access gallery f or the Three Mile Island ::uclear Station Unit 2 prior to issuance of a construction per=1t.
We have reviewed the site characteristics, interface sealing, and quality control which affect the tendon gallery ins tallation. We have. concluded the requested exemption =ay be granted provided review of additional information from the applicant shows a public need for the exe=ption.

EAR STATION C;IT 2 EXEMPTION REOUEST REVIE*,4 By letter dated May 1, 1969, the Metropolitan Edison Company and Jersey Central Power & Light Company, co-owners, submitted a request for an exemption from provisions of 10 CFR SL.10(b), which would allcw instal-lation of the tendon access gallery prior to issuance of a construction permit for the Three Mile Island Nuclear Station Unit 2.
A similar exe=ption was requested and granted prior to issuance of a construction permit for the Three Mile Island Nuclear Station Unit 1.
Our review of the exemption request was based upon the applicants' providing sufficient infor:ation to =eet the require =ents set forth in Section 50.12(b) dated February 19, 1969. These require ents are:
1.
Demonstration of a public need 2.
Adequate description and design criteria for exe=ption 3.
No unresolved saf ety questions 4
No saf ety questions likely to be identified 5.
Principal safety characteristics of the site similar to previously reviewed facility which has been issued a construction persi 6.
An adequate quality assurance program has been established.
We have reviewed the adequacy of the quality assurance program for construc-tion of the tenden access gallery recarding design, applic ble codes,

o concrete specificaticas and construction. We have also considered the applicants' quality assurance organication, and we conclude it is adequate to assure that the quality assurance program is carried cut throughcut construction of the tendon access gallery.
Tae applicants will present additional infor=atien to justify the need for the exe:ption with regard to =eeting the May 1973 load and reserve requirements. We will report orally on this catter to the Cc==ittee at its June meeting.
We conclude that the installation of the tendon access gallery exemption would not present 6 safety probles, and assusing that the request is justified with regard to anticipated public power requirements, we will propose that the Cc=issicn grant the request.
