s' Gas Company, Northern States Power Company et al.,
and Roche ster Gas and Electric Corporation et al. (hereinafter collectively referred to as " Licensees") move the Atomic Safety a.id Licensing Appeal Boards, pursuant to 10 C.F.R.
S 2.749, for summary disposition in the Licensees' favor of all issues (including without limitation the de minimis issue) in the consolidated radon prcceeding instituted in Philadelphia Electric Co. et al. (Peach Bottom Atomic Power St. tion, Units 2 and 3), ALAB-540, 9 NRC (1979).
As grounds for their Motion, Licensees allege that there is no genuine issue as to any material fact in this proceeding and that Licensees are entitled to a decision in their favor as a matter of law.
This Motion in supported by the Licensees' Statement Of Material Facts As To Which There Is No Genuine Issue To Be Heard, the Licensees' Brief In Support Of Joint Motion For Summary Disposition, and the Affidavit of Dr. Morton I.
Goldman, all filed simultaneously herewith.
