A.

The quali:7 of effluent discharged frc= Cutfall 001, Cc=hined Mechanical Draf t Cooling Tower 31cwdown, shall be li=ited at all times as fo11cus:

1.

The per=it:ee shall at all ti=es maintain in good working order and operate the Yechanical Draf Ceoling Towers (MDCT's) as efficiently as possible so as to

perature of the discharge; provided, however, the MDCT's =a/

be shut dew = when in the judg=ent of the responsible TMINS person =el a ce=bination of a =cspheric conditiens and river te=perature =ay exist which causes the waste water to be heated as it passes through the MDCT's or ice formation is cbserved to occur within the MDCT's.

2.

The te=perature of the discharge shall never exceed a =axi=u=

of 87 F, except when the a=bient river te=perature exceeds 670 F, in which case, the discharge te=perature shall not exceed the a=bient river ce=perature; the te=perature of the discharge 0

shall not change by more than 5 F during any one hour period.

7 A=bient river te=perature is the te=perature of the river upstreas of the heated waste discharge. The a=bient te=perature sa=pling point should be unaffected by any sources of waste heat.

The te=perature cf the intake water will be considered as a=bient river tenperature so long as the intake water is unaffected by TMI's or any other nearby heated water discharge.

3.

The following te=perature li=itations shall never be exceeded:

a.

During the period Nove=ber 1 through April 30 the te=perature of the discharge shall not exceed 120 F

above a=bient river te=perature.

b.

During the pericd May 1 through Oc:cber 31 the te=perature of the discharge shall not exceed 70 F above a=bient river te=perature.

c.

During plan: cooldown operations the te=perature of the discharge shall not exceed 12 F above a=bient river te=perature.

4.

At no ti=e shall the discharge exceed t_he rate of 150 =illica gallons per day as a 30-day average and shall not exceed 159.12 =illion gallonc per day as a =exi=u= at any ci=e.

The chief of the operations Section of the Haryisburg Regional Office of the Eureau cf Water Quality Manage =ent shall be advised by telephcne within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> when the MDCT's are shut dow= for reasons other than those specified in condition 1 above

_ and again when tower operation is resu=ed; chall be notified within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> when the discharge li=itations specified in paragraph 3 above are exceeded and again when the discharge is in ec=pliance with such li=ications; and shall be notified, at least 30 days in advance, whenever possible, of all scheduled plant cooldown operations.

6.

Within two years af ter both nuclear reactor units are in co==arcial operaticn, the Metropolitan Edisen Cc=pany will-collect and sub=it to the Depart =ent of Enviren= ental Resources strea= data which accurately defines the ther=al plu=e or zone of i= pact frc= the TMINS heated waste discharge. As a mini =u=,

ther=al plu=e =apping data collected to =eet the Nuclear Regulatory C==ission's require =ents shall be sub=itted to the Pennsylvania Depart =ent of Environ = ental Rescurces.

Chlorination of either unit discharge shall be li=ited to a total of two (2) hours per day. During periods of chlorination the total residual chlorine at discharge Cutf all C01 shall not exceed 0.2 =g/1.

C.

Within six =enths af ter Units 1 and 2 are in operation, the per=ittee shall sub=it to the Depart =ent data en the conf or=ance of _ Discharge-Cutf all 001 to the li=itations in Special Conditions A and 3.

The plans for which this cermit is issued are approved subject to the ennci tion tha t the waste trea tment plant constructed under said plans will pecduce an effluent satisfactory to the Department.

By this approval, neither the Department nor the Coccomvea!!h of Pennsylvania assumes any responsibility for the feasibility of the plans or the cperation of the plant to be constructed thereunder.

2.

All relevant and ncn-superseded conditions of any prior water quali ty management permi ts, decrees, or orders issued to the herein permi ttee or his predecessor shall be cen-tinued in full force and effect and together wi th the provisions of this permi t shall apply to his successors, lessees, heirs and assigns.

The responsibility for the carrying out of the cenditions of this permit shall res t upon the cwner, lessee, assignee, or other party in responsible managerial charge of the operation preducing the was tewaters and of the waste treatment works herein aporcved, such resconsibility passing wi th each succession in said control.

Approval of a discharge or facilities under a permit shall not b2 effective as to a new owner until a transfer has been executed and filed on forms pecvided by the Decartment and the transfer is approved by the Departcent.

4.

The' permittee shall secure any necessary permission frca the proper federal authority for any cutfall or industrial waste treatment s tructure which discharges into or enters navigable waters and shall cbtain approval of any stream crossing, encroachment or change of natural s tream conditions ccming within the jurisdiction of the Department.

5.

In order to avoid cbsolescen:c of the plans nf was te trea tment works, the approval cf the pinns herein granted, and the authori ty granted in the permit, i' no t speci fi cally ex tended, shall cease and be null ard / aid tue fears f eca the date of this cermi t unles s the wor ks covernd by said plans shall have been compicted and piaced ;c cptrati.'n en or before that date.

s 6.

Approval of plans refers to functional design and not structural. stability, which is assumed to be sound and in accordance with good structural design. Failure of the works herein approved because of faulty struc: ural 40g design or poor constructicn will render the permit void.

e 7.

The Department may at a subsequent time mcdify, suspend or revoke this permit whenever the waters affected by the presently authorized waste discharge have become so improved in character thecush natural or artificial processes of conservatien or reclamation as to render inimical or harmful the effluent frca the works herein approved, or whenever the Department increases treatment requirements for wastes generally.

Therefore, the permi: tee is hereby no:ified that when the Department shall have determined that the public interest requires the further treatment of such of the permi ttee's industrial wastes as are discharged to the waters of the Commonweal th, then upon notice by the Departmen t and,within the time specified, the permi ttee shall submi t to the Depa r tmen t for i ts approval, plans and a report providing for the required degree of treatment, and after approval thereof, shall cons truct such works in accordance with the requirements of the Departmen:.

8.

If at any :ime the industrial waste treatment works of the permi ttee, or any part thereof, or the discharge of the effluent therefrom, shall have created a public nuisance, or such discharge is causing or centributing to pollution of the wa ters of the cemmer..vea l th, the permi t tee sha ll forthwith adep: such remedial measures as' are acceptable to the Department.

9 Nothing herein contained shall be construed to be an intent en the part of the Department to approve any act made or to be made by the permi ttee incensis ten t wi th the permi ttee's lawful powers or wi th exis ting laws of the Cc=monweal th regulating indus trict was tes and the practice of professional engineering, nor shall this permi t be cons: rued to sanction any act othenvise forbidden by any of the laws of the Cem=cn-weal:n of Pennsylvania or of the Uni:ed States.

Construction 10.

The works shall be constructed under expert engineering supervision.and competent intpection, and in accordance with plans, designs, and other data as herein approved or amended, and wi th the ecndi tions of this permi t.

11.

No radical changes shall be made in the works herein a pp ro ved..v i thcu t approval of the Ce:ar tmen t.

12.

The outfall sewer or drain shall be extended to low water mark of the receiving body of water in such a manner as to insure the satisfactory dispersion of its effluent 'iereinto; insofar as practicable it shall have its outlet s' rged; and shail be constructed of cast iron, concrete, os er material approved by the Department; and shall be so prt

.ed agains t the effects of flood water, ice, or other ha ards as to reasonably insure its s tructural s tabili ty and f reedom f rom s toppage.

13 When tha herein acproved Industrial waste treatment works is canpleted and before it is placed in oceration, the permittee shall' notify the Oepartment so that an inspection of the works may be made by a representative of the Department.

Oceration and.waintenance

14. No matter how well designed and carefully cons tructed a waste treatment works may be, full ef fectiveness cannot be developed unless it is ef ficiently operated.

In order to secure such efficiency, protect the waters of the Commonwealth, and insure the most effectise and economical dosage when chemicals are used, the permi ttee 's required to place the works under the regular charge of a responsible plant official, and its opera-tion under the control of the designer of the works or other qualified person approved by the Department, for at least one

year after comoletion. Moreover, upcn wri tten notice f rom the D epa r tmen t, the permittee shall maintain era or more skilled operators regularly on duty for such daily periods as the Department may di rect.

15 The right to discharge the effluent from the herein approved industrial waste trea tment works into the waters of the Common-wealth is contingent upon such operation of these works as will at all times produce an effluent of a quality satisfactory to

'the Department.

If, in the opinion of the Cesartment, these works are not so operated or if by reason of change in the character of wastes or increased load upon the works, or changed use or condition of the receiving body of water, or otherwise, the said effluent ceases to be sa.tisfactory for such discharge, then upon notice by. the Cepartment the right herein granted to discharge such effluent shall cease and become null and void unless wi thin the time specified by the D epa r tme n t, the permittee shall adoot such remedial measures as will produce an effluent which, in the opinien of the "se; art-ment, will be satisf actory for discharge into the said receiving body of water.

16.

No untreated or ineffectively treated wastewaters shall at any time be discharced into the waters of the Commonwealth, and especial care shall be used to crevent accidental " spills" or (3) similar unusual discharges of ali raw, finished and waste materials.

17.

No storm water, sewage or other industrial wastes not speci-On fically approved herein, shall be admi tted to the wcrks for which this permit is issued, unless with the approval of the Department.

18. The varicus structures and apparatus of the industrial waste treatment works herein approved shall be maintained in proper condi tion so - tha t they will individually and collectively per-form the functions for which they were designed.

In order to insure the efficacy and pecper maintenance of the treatment works, the permitten shall make perledic inspections at suf fi-ciently frequent intervals to detect any impairment of the s tructural s tabili ty, adequate cacaci ty, or other requisi tes of the herein acproved works which might impai r their ef fective-ness, and shall take immediate s teps to correct any such impair-ment fcund to exis t.

19 Any screenings, and any settled or ficated s'a ids, shall at no time be permitted to accumulate in sedimentatien basins to a depth sufficient to interfere with the settling efficiency thereof. Any such material removed shall be handled and dis-

posed of so that a nuisance is not creatzd and so that every reasonable and practical precaution is taken to prevent the said material frcm reaching the waters of the Ccmmonwealth.

20.

The permittee shall keep records of operatien and efficiency h*

of the waste treatment works and shall submi t to the Depart-ment, promptly at the end of each ecath, such report thereen as may be required by the Department.

21.

The discharge of untreated or improperly treated industrial was tes to the waters of the Ccmmenwealth is centrary to the requirements of the Department.

If, because of accidental breakdcwn.of the treatment works or plant equipment or for other reasen, any such discharge should occur, then the operatico of the mill or process producing such discharge

'shall be discontinued until repairs to the treatment works or other satisfactory measures to prevent water pol;ution sha ll have been ccmpleted.
