i ORDER TO ASSUME AND CONFIPA DIRECT NRC REGULATORY AUTHORITY OVER EMERGENCY SITUATION Beginning March 25, 1979, a series of events at Unit No. 2 of the Three Mile Island Nuclear Power Stacion resulted in an emergency situation which continues to exist.

The Atenic 7nergy Act of 1954 confers broad regulatory power on the Nuclear Regulatory Conraission to protect public health and safety, including plenary authority to control actions to be taken by a licensee in an energency situation.

Representatives of the licensee aave agreed that the Comission does have the authority, in the event of any disagreement, to detennine which steps shall be taken.

Nevertheless, since important safety decisions remai.. to be made, the Cocnission believes it necessary to confinn its previous understandings wit.1 the licensee and to dispel any possible doubt about where the authority to i

decide those questions resides.
