I Summarv - The NRC has already inquired into the matter reported by

  • the Los Angeles Times on April 17. 1979 It apoears that the matter relates to a technical report from the Meted quality Assurance Supervisor to the Meted Manager, quality Assurance Power Generator.

The report, dated April 13, 1979, identifies apparent deficiencies in tests performed by a Contractor, Nuclear Energy Services (NES), on TMl Unit #1 during the current shutdown.

These tests, required by the NRC to be performed ceriodi-cally, are designed to ver,ify the fact that certain welds that were originally certified to be correct have not deteriorated in service.

Our preliminary review reveals that the deficiencies most likely relate to whether the contractor actually and properly performed all of tSe tests contracted for.

At this time we have no information that indicates that the welds are not satisfactory or that the periodic testing for adequacy is overdue in relation to our require-ments.

Action - The NRC is investigating the matter and will assure that our requirements are complied with.

The report of our investiga-tion will be made public as is our normal practice.

In fairness i wish to note that our preliminary review indicates the matter was recently identified bv the Quality Control program of Meted and that the time period for such tests and reports to the NRC have not been exceeded.

It is further reccarnended that management renegotiatr the ISI contract with NES such that penalty clauses including the costs of erection of scaffolding, insulation removal, weld preparation, reinstallatiod of insulation plus overhead costs in planning and supporting each inspection becorre effective agair.st NES should credit for a given inspection be denied by tS NRC for any nondestructive examination performed by them in the future.

It is further recorroended that Licensing review the above infonr.ation for NRC reportabili ty.
