NRC STAFF REPLY TO PARTIES CPPOSING ITS APRIL 27, 1978 MOTION In view uf the unanimously negative reaction of the parties who have filed responses to the Staff's April 27, 1978 " Motion to Consolidate Proceedings tc Receive New Evidence With Regard to Radon Releases and Associated Health Effects," the Staff has feit c51iged to consider the points raised by the opoonents with an open mind and a clear awareness that there may be more than one reasonable acccr:modation of the many interests involved here. We have tried to do so, and we continue to believe that our suggested procedure warrants serious consideration by the Appeal Board.

_.1 A major prenise of the Staff's motion was that the Acceal Board would desire that a substantial probing be made of the Staff testimony on the radon issue even in cases in which no other party sought to contro-vert, modify or supplanent that testimony.--1/
Such a sua spente inquiry could be undertaken by the Appeal Board itself cr by delegating the responsibility to tne various Licensing Boards on remand, possibly with some specific instructions, guidelines or set of cuestions from the Appeal Scard.
It was our basic purpose to suggest that the former was the more sensible course; and none of the various applicant's expressed objections to having their " simple case" turned into a "co.iplicated case" in any way demonstrate that we are wrong in this judgme.
On the other hand, it may be that now that the Appeal Board morbers have cad further opportunity to examine the proposed Staff testimony, they are satisfied that no such substantial probing of it is needed in., con-tested cases or in those cases in which no int 9:vc 7r controverts the Staff testimony.
In that event, the procedural coarse suggested by many applicants with respect to such cases --
.e., of entering findings and conclusions based on the staff testimony -- is obviously appropriate.
We had anticipated that there would be a number of cases in which parties would indicate their intention either substantially to supple-ment er to controvert the Staff evidence on the radon issue. While it 1/ Some inquiry of this sort has already been undertaken by the Perkins and Pebbic Sorings boards.
@ is not possible to draw any definite conclusions from the responses sub-mitted, at least preliminary indications are that we might be in error in this expectatica. Thus far, only the Sterling and Three Mile Island intervenors have indicated an intent to controvert the Staff evidence.
If the Appeal Board does intend to pursue a substantial sua sponte inquiry and if it does agree with our suggestion that this can be done most sensibly on a consolidated basis, we would have no objection to cmitti ig from the consolidation those proceedings in which sane other party (1) indicates its intention to perfonn a substantial independent rule in the development of the record, and (2) objects to participating in a consolidated proceeding.
We note finally that several applicants have suggested in thair responses that their proceedings not be reopened at all to receive evidence on the radon issue because they are pendina be ore the Appeal Board only f
on a limited issue which is totally unrelated to the radon question.
In filing its motion, the Staff was aware of the fact that the pending Apoeal Scart cases present a wide range of different proceoural postures, and that in scoe of the pending cases, it could be fairly argued that the Appeal Board had already ccmoleted its review of Licensing Scard deter-minations with rescec: *o the envircreental effects of the uranium fuel cycle and the overall cost-benefit balance. Nevertheless, we found the Comission direction to be quite unambiguous and the Statement of

9 Considerations accompanying the rule change to fall short of indicating that the plain meaning of that direction should not be implemented.
While reasonable arguments have been made by several applicants, we believe that any shading of the plain meaning of the Ccmission's direc-tion should come fran the Commission itself.
