STM-SMH is unsure whether this matter of ALA3-480 is prescently pending solely before the Ccmmission or whether it is pending before both the Appeal 3 card and the Ccmmission; your indulgence is requested with regard to paragraph 7 below; STM-SMH requests that the proper bcdy accept same as a timely filing.

That on ?Tovember 8, 1977, the NRC Staff sent to the Appeal 3 card a copy of a memorandum from Dr. Walter Jordan, a member of the ASLA3 panel, pointing cut what he thought of as errcrs in Table S-3 in 10 CFR S1.20 (e).

Dr. Jordan said the impact frcm radon-222 in mining and milling uranium given in Table S-3 was 1C0,000 times too icw.

On March 2, 1978, the Commission ordered the Appeal Scard in the Ihree Mile Island Proceeding to reopen that case and decide the matter of mining and milling impact as if there were no entry in Table S-3.

Ecology Action moved to reopen the Sterling record on March 15, 1978, to hear evidence en the impacts frca raden-222 and other icnglived radioiso cpes released in the uranium fuel cycle.

Said May 5, 1978, Order also stated

. Ecology Action has proferred no evidence to suggest that raden is generated in quantities sufficient to have possibly serious health or environmental consequences.

Ior are we aware of the existence of any evidence to that affect."

STV-EMH advises the Commission that the Sterling matter should not unduly sway them for the following reasons:

1)

A Construction.ermit has been authorized for said Marble Hill plant after the issuance of an LWA I and LWA II, and, 2)

It cannot rationally be assumed tha: the fuel for the prcposed Mar' ole Hill plant has already been mined,' since there are severe questicns remaining regarding he impacts of radon-222 resulting frca mining and milling,,s'o

The above is no: Oc state that STV-SMH does not fully support the efforts of Ecology Action and the Intervencrs in Three Mile Island.

It is our position that all Nuclear Ccnstruction Permit requests be placed in abeyance until the impacts from raden-222 can be fully explored and adjudged environmentally safe.

4 STV-SMH as a substantial comment, would take particular issue with the May 5, 1978 Order of the Appeal Scard in the Sterling matter when it presupposed that Icciogy Action bear the burden of proof that radon is generated in quantities sufficient Oc have possibly sericus health or envirctmental consequences.

The NRC Commission may wish Oc change the rules of said proceeding, but, it is our opinion that the issue of radon-222 impact hac already been dec 1.ared "in doubt" and that URC Staff and the various Applicants should prove in a crima f acie manner that radon 2nd its daughters do not pose serious he alth and environmental consequences.

The Appeal 3 card's memorandum and Order dated October 14, 1977, in re Marble Hill Units 1 and 2, page 12, stated:

"'ihe re a request for equitable relief is consddered, however, we are disinclined Oc let the ac,vant profit from an error which is induced regardless of 1 nw well-intentioned it might have been."

Since the :TRC Staff intentionally or negligently allowed Table S-3 Oc be includable in the Three Mile Island, Sterling and all other proceedings of like nature, said S:cff should now bear the brunt c f the burden cf procf Oc shcw categcrically tha: the impacts frcm radon-222 have nc serious health or environmental consec 2ences.

. January 20, 1979, it is Our opinion that no conclusive new information is available to settle whether the impact of radon-222, assuming the inaccuracies of Table S-J, is more or less dangercus to the health and safety of the populace adjacent to said uranium mines.

With regard to the affidavi cf Jack E. Rothfieisch dated January la, 1978, no new informaticn was adduced.

The Affidavit of R.

L. Gotchy dated March 28, 1978, represents, in our opinion, a " whitewash" of the prior inconsistencies in Table S-3.

The affidavi of R. M. Wilde dated March 28, 1978, seems c

be based upon personal telephone communications frc= two scurces:

James Cleveland, Ken McGee Nuclear Corporation, Grants, New Mexico, on January 30, 1978, and Edward Kaufman, New Mexico Environmental Improvement Agency, Santa Fe, New Mexico on February 3, 1978.

Wilde's statement that he has been associated professionally with both for several years does not cure the rank hearsay nature of said testimony.

No tests or studies are made avalable to the reader to verify the accuracy and care of such so-called " data which provide (s) the basis for the source term" used by Wilde.

Another cc= ment that can and should be made concerning Wilde's March 22, 1973 Affidavit is that such hearsay estimates were based on " limited" sampling data.

In sum.Tary it is stated:

"For cpen pit mines, until such study is completed, there is just no reliable informa 1cn available upon which to base estimates of radon release."

Wilde has emitted from censideration such vast surfaces of radon releases as have been brought to light in the use by Grand Juncticn Colorado residents Of tailings spread throughout its area as fill, f:undaciens,

Mr. Paul Magno in his affidavit of January 16, 1973, has failed Oc add to his calcula;ica cf tailings area near the end of mill life, the enormously larger surface. acvered by mill tailings which have been utiliced by pecple, (e.g., in Grand Junction Colorado for fill, etc., as noted above).

With regard to the Supplemental Affidavit of R. L.

Gotchy dated May 10, 1978, 1 can fairly be said that the sumnary and conclusions are not responsive to the crucial issues which are to be addressed.

Gotchy states:

"For the reasons discussed above, it is extremely difficult to provide precise quantitative values for excess =cr:ality and morbidity particularly for the coal fuel cycle The fact is, hcwever, tha: the difficulty is far greater for the uranium fuel cycle.

The products of the ccal fuel cycle. namely:

sulfur dioxide, fly ash, oxides of ni rcgen, carbon acnoxide, etc., are biodegradable ; whereas the products of the nuclear fuel cycle cumulate and their half-lives cannot be influenced by human intervention in any economically feasible

'ashion.

Whereas the adverse effects of the coal cycle have a definite termination, those of the nuclear cycle are irreversible and irreparable in their damage and essentially without time limit on their effects.

The cumulative nature thereby adds to the " v alue s for excess-mortality and morbidity" in a manner possibly not accounted for in.the lexicon of R.
