e t. flRC STAFF RESPONSE TO ALAB-509 INTRODUCT1071 In April 1978, the Commission held incorrect the value assigned in Table S-3 (10 CFR Part 51) to the emissions of radon-222 expected to occur as a result of the mining and milling of uranium. 43 Fed. Rec.15613 (April 14, 1978). The Commission, at that time, instructed Atomic Safety and Licensing Boaris and Atomic Safety and Licensing Appeal Boards to reopen the records in pending licensing proceedings to receive "new evidence on radon releases and on health effects resulting from radon releases.' Id. at 15615-16. The Appeal Boards decided in ALAB-480 that, in implementing the Commission's directive, it would be advantageous to be-in with the record made before the Licensing Board in proceeding.S Accordingly, the Appeal Board called the Perkins upon the parties in the above-captioned proceedings to frame their positions in terms of the Perkins record and the Licensing Board's subsequent decision in that proceeding. 7 NRC 796 at 804-06. i Various parties to these proceedings subsequently filed papers which the Appeal Boards considered and discussed in ALAB-509. Radon Emissions Although a number of parties responded to ALAB-480 by submitting to the Appeal Boards' objections about various aspects of the Perkins record, most i of those objections went to the adequacy of the Perkins record cn the question of health effects. As noted by the Appeal Boards, most parties seemed willing to ac. cept both the evidence and the decision in Perkins on the levels of radon emissions and the resulting concentrations to 9 which the population is exposed. (ALAB-509 at 6). 3/ However, the responses to ALAB-480 filed by intervenors in Sterling and Tyrone suggested in general terms that more evidence should be adduced on ti. ~ - Boards indicated that they required additianal information concerning theobjectionsraisedbySterlingandTyroneinterve[orstothePerkins figures (ALAB-509, p. 7), and called upon the intervenors in Sterling and Tyrone to provide a particularized memorandum setting forth certain details of their objections. In response to the Appeal Board's direction in ALAB-509, Sterling and Tyrone intervenors, on February 19, 1979, filed a 1.t of some 26 specific alleged deficiencies in the Perkins record with respect to radon release. The Staff believes that these deficiencies are appropriate for further consideratinn and should be addressed by affidavits, depositions or further limited hearings, if necessary. Health Effects - De Minimus Theory With regard to tne remaining issue - the dg minimus ef fect vel non of the 1 release of radon, the Appeal Boards, in ALAB-509, noted that the Perkins Licensing Board had stated that: ~ l Based on tne record available to this Board, we find that the best mechanism available to charac-terize the significance of the radon releases associated with the mining and milling of the nuclear fuel for the Perkins facility is to compare such releases with those associated w'th natural bac kg ro u.1d. The increase in background associated with Perkins is so small compared with background and so small in comparison with the fluctuations 1 in background, as to be completely undetectable. . The Appeal Boards observed: If we were to subscribe to t.iat view, there wou' ' appear to be no reason to consider the question of health effects further. Consequently, we believe it appropriate to consider this aspect of the Board's decision at the outset. ALAR-509, p. 9. Accordingly, the Appeal Boards provided the opportunity for any party who disagreed 'sith the approach taken by the Perkins Licensing Board to brief the matter. Sterling and Tyrone intervenors expressed their views in the response filed on February 19, 1979. Peach Bottom and Three Mile Island 2 intervenors expressed their views in a response also dated February 19, 1979. This latter filing also contains numerous charges of Staff fraud or cover-up which the Staff has previously responded to in prior filings on the radon matter. The filing does not provide, as was done by the Sterling and Tyrone intervenors, any particularization as to any I errors in the radon release values found in the Perkins record. It does, however, address the de mininus approach taken by the Perkins Licensing Board. Staff Position on De Minimus Theory Although articulated in various waye, the gist of the several objections to the "de minimus" approach of the Perkins Licensing Board decision is as follcws. It is improper to reach the conclusion that the health effects from radcn released from the uranium fuel cycle are insignificant by comparing such releases to natural background radon. Intervenors argue i that the Perkins record shows that the estimated ieleases for Perkins, 100 curies per 110 annual fuel requirements (AFR) for 1000 years resgips 00 J4a)
i 4 - in 132 deaths. They then argue that since this relationship will hold for all time, "we recognize 4800 deaths during the 10,000-year period and 230,000,000 deaths during the billion year period." They argue that it is this value of 230,000,000 ultimate deaths which must be weighed against the perceived benefit of generating electricity. In short, they urge that such a large cumulative increment in health effects cannot be dismissed as insignificant by comparing it to background radon exposure. Intervenor's argument uses a simplified computation of health effects similar to that used by Dr. Kepford in the Perkins record. This computa-tio' simply :akes health effects, based on Dr. Gotchy's estimates for the first 10)0 years, and extrapolates such effects, based on release rate i estimates, out to enormous periods of time into the future. (Page 19 of i Sterling-Tyrone intervenor's filing uses the figure 230 million deaths over a period of a billion years into the future.) In the Staff's view, the crux of the problem is actually ridestepped by l such a formulation of the question. If, indeed, the future health effects attributable to the radon released from the uranium fuel cycle were, in fact, a known quantity, ther, the point Intervenors have raised would be valid and might warrant additional, and concedely difficult, assessment of how, under the policies which underly NEPA, a known future damage is to be weighed against a present benefit. However, to frame it in this fashion poses a questicn different from that which faced the Licensing Board in Perkins proceeding. A 7 hb OJ
~- _g. + In the Perkins record and in that Licensing Board's decision, the difficult problem facing the Board was how to estimate what the potential future health effects might be which may be attributable to radon released thousands of years into the future from activities carried out today. The record in Perkins makes clear three very different approaches concerning treatment af the difficult unknowns involved in such an attempt to estimate health effects far into the future. Dr. Kepford's approach is mentioned above. Staff witness Dr. R. L. Gotchy provided a conservative numerical estimate of cancer mortality for periods of from 100 to 1000 years into the. future based on the data from other witnesses and the assumptions set forth in his testimony (Gotchy written testimony.following Tr. 2369).S

testimony, however, also discussed the difficulties associated with projections far into the future; viz., changes in population patterns, climatic conditions, life expectsncies and medical knowledge which are all essential compcnents of any estimate of the level of radiation exposure and estimates of health effects attributable to any given level af radiation exposure (Gotchy written testimony at 11-13, and Tr. 2418-20). Ir. light of the inability to make meaningful projections of health effects for periods beyond 1000 years into the future, Dr. Gotchy provided a 3riscn of doses from projected radon releases against those from .iatural background radon. '~ I f one AFR is for time periods out to 10,000 years, approximately 10/100,000 percent or, as a fraction about one-one-millionth of natural background radon dose. He concluded that this tiny fractional increase was insign-ificaat compared to natural background (Gotchy 13-18 and Table 8). Dr. L. Hamilton, Perkins Applicant's witness, took another tack. His testimony discussed why the use of traditional risk estimates are inapprop-riate at such exceedingly low levels cf exposure as those discussed on the Perkins recora. Specifically, the exclusion of the repair mechanisms may be inappropriate at the very low levels of exposure under consideration ir connection with radon released from the uranium fuel cycle. (Tr. 2271, 2323,2333). Dr. Hamilton then went on to compare such exposures attributable to radon released from the uranium fuel cycle to natural background radiation and to the fluctuations in natural background radon exposure. His estimates show exposure estimated for radon releases from production of uranium for one AFR results in an average exposure of less than one thousar.dth of one millirem. He then ccmpared this incremental exposure with the fluctuations due to every day experiences, such l as traveling around the country by airplane, and to the differences in i radon exposure due to spending time indoors as distinguished from scending time outdoors. (Tr. 2322-23, 2278, 2280). Dr. M. Goldman, another Perkins Applicant's witness, in nis testimony gives quantitative values of releases and provides perspective on Dr. Hamilton's testimony. Dr. Goldman's testimony indicates radon deses, for indoor exposures in concrete or brick houses, may be on the order of 10 times greater than the average outdoor radon exposures. He then testified that the lung dose conmitmtat calculated by
f s _ i ~ the NRC Staff for radon releases from mining and milling for the first 500 years (or 5,200 man rem) would be balanced by (or is the same as) reducing the amount of time the average person in the U.S. population spends indoors by less than 10 minutes once in a 500-year period. (Goldman,

The Perkins Board assessed these different approaches and, based on the record, accepted as the best mechanism to characterize the significance of radon releases a comparison of such releases with natural background radiation and the fluctuations in s';ch natural b6ckground radiation. l Thus, t:ith evidence demonstrated by a number of approaches that the health effects.:.ttributable to radon releases from mining and milling in the uranium fuel cycle are very small, we believe that comparison to fluctua-tions in background radon exposure resulting from every day experiences provides a valid basis for characterization of the significance of such impacts and such comparison shows that the impacts attributable to releases of radon from uranium mining and milling for Perkins (and thus i for similar plants) is insignificant. g8 3kb
