ksed en cur discussions yesterday with Bill Regan, we are reviewing the legal prepriety of lifting tne suspension of the subject trans-mission line established by Comission Order. Under the circum-stances of this case, we have consideraule dcubt with respect to whether the suspension should be lifted prior to full consideration by cognizant ASLB (I will not include all the ramifications and possibilities that might arise in tne hearing context. I will be glad to discuss these with you at ycur convenience.) Since our legal review is in progress, we are unable to concur in the propcsed letter to Metropolitan Edisen because it comprcrnises a potential legal position to be taxen by this office. Tne second sentence in the second paragraph concedes that a basis exists fer reconsideration of the suspension orcer. Although this r.ay be twe, it is improper to convey this tnought until our legal position is solidified.

I suggest the second paragrapn of the proposed letter be deleted, that we merely state that the mattar is under review and we will convey our conclusions to them in the near future.
