NOTICE OF OPPORTUNITY FOR PUBLIC PARTICIPATION IN PROPOSED AEC LICENSING ACTION FOR THREE MILE ISLAND NUCLEAR STATION, UNIT 2 The Atomic Energy Commission is givinc public notice th a t it is considering issuance of an ocerating license to ?te trccclicar Edison Company, Jersey Central Pcwer & Light Corpany, and Pennsylvania Electric Company for oceration of the Three '4ile Island Nuclear Station, Unit 2 (the facility), located on Three Mile Island in Londonderry Township, Dauphin Ccunty, Pennsylvania.

The facility is subject to the provisions of Section C cf Appendix D to 10 CFR Part 50, which sets forth crocedures acolicable to review of environmental considerations for production and utilization facilities for which construction permits were issued prior to January 1, 1970.

The notice provides that within 30 days after cublication of notice in the FEDERAL REGISTER on May 28., 1974, any member of the cublic whose interest may be affected by the proceeding may file a

request for a public hearing in the form of a petition for leave to intervene (1) with respect to whether, considering those matters covered by Apcendix D to 10 CFR Part 50 of the Commission's regulations, the orovisional construction permit should be continued, modified, terminated or approcriately Toyaqoos 3,80-158

. conditioned to protect environmental values; and (2) with rescect to whether an operating license should be issued.

Petitions for leave to intervene must be filed under ca:P or affirmation and must set forth the interest of the petitioner in the proceeding, how that interest may be affected by the results of the croceeding, and the petitioner's contentions with respect to the procosed licensing action.

Such cetitions must be filed in accordance with the abcVe-referenced FEDERAL REGISTER notice and must be filed with the Secretary of the Commission, U.S.

A petition for leave to intervene mus t be accompanied by a supporting affidavit which identifies the specific ascect or aspects of the proceeding as to which intervention is desired and specifies with particularity the facts en which the petitioner relies as to both his interest and ".is contentions80-159

Petitions stating contentions relating only to matters outside the Commission's jurisdiction will be denied.

All petitions will be acted upon by the Ccmmission or designated licensing board or by the Chairman of the Atomic Safety and Licensing Board Panel.

Timely petitions will be considered to determine whether a hearing should be noticed or another appropriate order issued regarding the disposition of the cetitions.

In the event that a hearing is held and a cerson is permitted to intervene, he becomes a party to the croceedin, and has a right to participate fully in the conduct of the hearing.

For example, he may present evidence and examine and cross-examine witnesses.

A copy of the FEDERAL REGISTER notice is on file for public inspection at the Government Publications Section, State Library of Pennsylvania, Box 1601 (Education Building), Harrisburg, Pennsylvania 17126, between the hours of 8:30 AM and 5:00 PM, Monday, Wednesday, Friday and Saturday, and 8:30 AM and 9:00 PM, Tuesday and Thursday, and the Commission has arranged for other documents and correspondence relating to the licensing of this facility to be kept at the same location.80-160
