Dear Mr. Wells:

t This is in response to your letter of May 27, 1974, to the Secretary of the Commission expressing your desire to intervene in the operating licensing proceeding for Three M1le Island Unit 2 (TMI-2).

I am enclosing the following material for your information:

1.

Federal Register fictice of Application for Facility Operating License, TMI-2, 39 FR IPA 97, May 2G, 1974.

2.

Cocnission's Rules of Practice,10 CFR Parts 2, 20, 50, 100.

3.

Safety Evaluation TMI-2, September,1969 (to be updated).

4.

Final Environmental Statement, THI-2, December,1972, (to be updated).

The requirements for intervention are stated in Section 2.714 of 10 CFR Part R, which is enclosed, and page 1FA98 of the enclosed Federal Register i

notice.

Please note that petitions to intervene must be filed no later than June 27, 1974.

If a hearing is held, persons not intervening may make a limited appearan::e statement at the discretion of the presiding o.fficer.

Section 2.715 of 10 CFR Part 2 provides for this form of participation.

In practice, the presiding officer usually inquires early on the first day of the hearing whether there are any individuals in attendance who wish to make limited appearance statements.

In most cases, limitad appearance statements are heard or incorporated in the record as if read, only on the first day.

However, I wculd note that the presiding officar has considerable discretion as to limited appearance statements, and in particular as to the timing of such stataments.
