y NRC STAFF REQUEST FOR EXTENSION OF TL'.tE By order dated January 3,1978, the Appeal Board allowed the Intervenors until January 13, 1978 to file a supplemental memorandum in support of their motion for a stay of the initial decision rendered by the Licensing Board on December 19, 1977. In accordance with the Appeal Board's ruling, the Intervenors filed "Intervenors' Supplemental Memorandum in Supper of Motion fe Stay of Initial Decision" ("Supplemantal Memorandum") on Jan-uary 13,1978.

Pursuant to the Commission's regulations, specifically 10 CFR S 2.783, parties may respond to the Supplemental Memorandum, allowing three days for mailing, by January 23, 1978. For the reasons set forth below, the NRC Staff requests an extension of time until January 25, 1973 to file a response to the Supplemental Memorandum.

s The Supplemental Memorandum was received by our office on Januar'f 17, 1978, four days after mailing. In addition, both Staff counsel assigned to this case were enbaged in another hearing out of town when the Supplemental Memorandum was received.*

We believe these circumstances justify the requested extension period. Since the Applicant requested the same extension and the Appeal Board granted that extension, we do not believe any party would be prejudiced or that any delay will result.
