Dear Chair.an Hendrie:
Recent events since January 1,1979, have demonstrated the critical need for the Nuclear Regulatory Co==ission to co=pletely re-vise its standards and procedures relative to the licensing of nuclear plants. The first major element was the rejection by the Co==ission of the Ras =uessen Report and its erroneous Fault Tree analysis. The second =aj or event is the disaster at the Three Mile Island Nuclear Plant.
b'e in Cleveland are concerned because of the Cleveland Electric Illu=inating Companf;s building program at Perry, Ohio.
The reccrds of inspection by the Nuclear Regulatory Co==ission of the Perry Plant over the past year clearly demonstrate an insensivitivy of the Illu=inating Co=pany to proper builiding procedures. The inspections concinually report i= proper docu=ent contrel; improper supervisory inspections; improper supervision; and i= proper construction. Mistakes will occur in any pro-ject, but when there is a continual pattern of i= proper activities, as has been demonstrated at Perry, action must be taken to protect the public.
Considering the inherent danger of nuclear energy, and further censidering the events of 1979, I must insist that the Nuclear Regulatory Cc==ission initiate the following action:
1.
To order i==ediately the shut down of all operating nuclear plants which have the same design as that employed at the Three Mile Island Nuclear facility; 2.
That all such facilities be inspected by a team of engineers representing the nuclear industry; the Nuclear Regulatory Co==ission and the Union of Concerned Scientists; 3.
That the Nuclear Legulatorv Cc==ission create an office of Nuclear C= buds =an which would have the power to issue show cause orders in the event it receives information which would warrant such action and further which would enable the public to parti-cipate more fully in the licensing process;

That the Nuclear Regulatory Commission, by regul-ation, require the posting of a sufficient indemnity bond by all Utilities desiring to build or operate or shut down nuclear power plants to protect the public; 5.
That the Nuclear Regulatory Co==ission, by regulation, supersede any State Regulations to the contrary and
_ require that the costs of any and all accidents in-cluding any necessary security and clean up work per-for cd by the Federal Government be born by the Utility involved and not be permitted to be passed through to the consumer.
