January 16, 1981 OFFCE OF THE OOuutSSIONER MDiOPJJiDUM FOR:

Chairman Ahearne Comissioner Gilinsky Comissioner_ Hendrie FROM:

Peter A. Bra c At our last meeting on the procedural rule covering the disposal of high-level radioactive wastes in geologic repositories, I agreed to provide suggested language for inclusion in Section 60.32 regarding essential conditions in the construction permit. The language I would suggest would be a new subsection (c) as follows:

The construction permit will explicitly state those features (c) of the application deemed by the Commission to be so essential to the protection of the public health and safety that thef i

may not be deviated frx, during subsequent construction without prior approval from the Comission.

Existing subsection (c) would be changed to subsection (d).
