Docket Nos. 50-498 and 50-499 Gentlemen:
On December 26, 1979 Citizens Concerned About Nuclear Power, Inc. (CCANP) filed " Answers of Citizens Concerned About Nuclear Power, Inc. to the First Set of Interrogatories and to NRC Staff Interrogatories and Request For Documents" (hereinafter referred to as " Response").
In this Response CCANP indicated that both the Applicants and the Staff's interrogatories requested the same information.
Based on that observation, CCANP responded only to the Applicants' interrogatories, leaving for the Staff the task of parsing from these answers information responsive to its own interrogatories.
In its Response CCANP proffered to respond directly to the Staff's interrogatories upon the Staff's request.
The Staff made that request during a conference call with CCANP's representa-tive, Mr. Lanny Sinkin, on January 4, 1980.
Mr. Sinkin indicated that each of the Staff's interrogatories would be answered.
The attached motion to compel is filed solely for the purpose of preserving the Sta:f's right to receive answers responsive to its interrogatories. The Commission's Rules of Practice indicate that the Staff must make such a filing within ten days of the date of the responses to its interrogatories. As noted above, CCANP's Response is dated December 26, 1979.
We will keep the Board advised regarding the disposition of this matter.
