Dear Congressman Mazzoli:

I am pleased to respond to your letter of September 28, 1979, concerning the construction problems at the Marble Hill Nuclear Power Plant construction site.

My colleagues and I share your concerns over the quality of construction activities conducted to date at this site. You may know that our Director of the Office of Inspection and Enforcement suspended safety-related construction activities for the Marble Hill Nuclear Power Plant, Units 1 and 2 until he finds reasonable assurance that such activities will be conducted in accordance with the Commission's quality assurance requirements.

The Order (Enclosure) specified nine areas where action by the Licensee needed to be taken including the review of the contracts of the contractor and sub-contractors and qualifica-tion of workers including management involved in this project.

Construction will not be permitted until the Licensee's actions and responses have been carefully reviewed and the required findings made.

To supplement the inspection activities at this site a resident inspector has been assigned to it.

The NRC is comitted to make every reasonable effort to assure construction is in accordance with our requirements.

However, your concerns about the cost of delays and construction errors are not within our statutory mandate.

The cost of construction is a matter reserved to the state regulatory commissions.

You can be assured that if construction is allowed to continue, it will be closely monitored to assure compliance with our requirements.

A license to operate the facility will not be issued until a complete operating license review has been made, opportunity for a public hearing has been provided, and this Commission is satisfied with all aspects of this facility.

If you have any further questions on this matter, I will be pleased to respond.

ORDER CONFIRMING SUSPENSION OF CONSTRUCTION I

The Public Service Company of Indiana (PSI or licensee) is the holder of Construction Permits, Nos. CPPR-170 and CPPR-171, issued on April 4,1978.

These pemits authorize in accordance with their provisions construction of the thrble Hill Nuclear Generating Station, Units 1 and 2.

Over the past few months, serious problems have been identified at the Marble Hill facility con-cerning the adequacy of the licensee's quality assurance program and, in particular, the adequacy of concr6te placement which requires escalated enf_orcement acticn.

l/3g g3 II As a result of an inspection conducted on April 3-6, 1979, a Notice of Violation was issued to the licensee on May 4,1979. One item in the Notice identified nonco:pliance with Criterion X of Appendix B to 10 CFR Part 50 related to poor control of the quality of coi1 crete placement activities at the site.

During another inspection conducted on April 30 through May 3,1979.

additional item of noncompliance were identified.

How-E' ever, as the incident earlier this year at the Three Mile Island Nuclear Plant has affirmed, extreme care must be used in build-L.._,

In light of this, I find recent developments at the Marble

Not only is this going to further chip away support for this vital element

Public Service Indiana's (PSI) mismanagement of plant

construction is appalling.

PSI President, Mr. Hugh Barker, has admitted that contractors and supervisory staff are inex-perienced and that a higher priority was placed on cutting costs and construction short-cuts than on following strict safety

s standards on the construction site.

But, yet, the NRC which M=

is entrusted with the ultimate responsibility of protecting 3.?

the public health, safety and environment by regulating and supervising nuclear plant construction and management, failed
