Claire Commissioner - Engineer State Board of Land Commissioners Department of Natural Resources 620 Centennial Building 1313 Sherman Street Denver, Colorado 80203 Dear Mr. Claira-Your letter of October 30, 1979, requested a copy of the Hansen Project Environmental Impact Statement (EIS) and the U.S. Nuclear Regulatory Commission's (NRC) waste management program do::uments, and information regarding the disposal sites for nuclear wastes.

The Uranium Mill Tailings Radiation Control Act of 1970 was recently amended by Congress to provide clarification to Sections 204(e) and 204(fi). This clarification provides that the NRC shall no longer have direct licensing authority over the disposal of uranium mill. tailings produced in Agreement States. As a result, the NRC withdrew its intent tc prepare a draft EIS.

A copy of the Federal Register Notice (44 FR 64131, November 6,1979) describing this action is provided as Enclosure 1.

Since the State of Colorado has licensing authcrity over the Hansen Project, you should ask Mr. James L. Montgomery, Radiation and Hazardous Wastes Control Division, Colorado Department of Health, 4210 East lith Avenue, Denver, CO 80220, to keep you informed of their activities.

The NRC staff has prepared draft documents describing their low-level and high-level waste management programs (Enclosures 2 and 3). These documents outline our current regulatory requirements for the disposal of nuclear wastes.

The " Draft Generic Environmental Impact Statement on Uranium Milling,"

published April 1979 (Enclosure 4) which was prepared and issued by the NRC staff, outlines technical issues and criteria which are considered in performing our licensing assessments.

Also enclosed for your information is a copy of the " Report to the President by the Interagency Review Group on Nuclear Waste Management," published March 1979 (Enclosure 5). This report provides recommendations for the establishment of an Administrative Policy with respect to long-term management of nuclear wastes and supporting programs to implement the policy.

It should be noted that Appendix D of this report presents detailed information on projected and present quantities of waste, disposal requirements, and existing disposal sites.
