MEMORANDUM FOR:
Robert Var: Houten Office of Nuclear Regulat gy Research FROM:
Saul Levine, Director i
Office of Nuclear Regula ory Research
SUBJECT:
EXEMPTION TO 10 CFR 0.735-21 I have reviewed your Confidential Statement of Employment and Financial Interests (Form NRC-269) and note that you report, as a former employee of the General Electric Company, a vested interest in its retirement program.
In order to allow you to work on matters involving the General Electric Company, an exemption from the provisions of 10 CFR 0.735-21 must be granted.
A review of the terms of the General Electric pension plan by the Office of the General Counsel has revealed that, as an NRC employee, you cannot influence, in any fashion, the amount you receive as a pension from General Electric.
Based upon this finding, I have determined that your interest in General Electric is not so substantial as to be deemed likely to affect the integrity of your services to NRC and that no provision of law and no NRC regulation would appear to be violated by your partici-pation in matters affecting General Electric.
Therefore, with the concurrence of the Office of the General Counsel, you are hereby granted an exemption from the require-ments of 10 CFR 0.735-21 and you may participate in matters before the NRC affecting General Electric, cc:
