This is in regard to your requests for approval of routes to be used for shipment of irradiated BWR and PWR fuel rods being shipped for waste disposal or additional research from Battelle-Columbus Laboratories, Nuclear Science Area,

State Route 142. West Jefferson, Ohio to Nuclear Engineering Company, Inc. and Rockwell Hanford Company, Richland, Washington, as contained in your letters of August 8 and 30, 1979.

We have determined that the "Tri-State Primary Route" and the "Battelle-Columbus Alternate Route " which pass through cities considered to be heavily populated are.as, do not meet the requirements of 10 CFR Part 73.37(a)(3). Accordingly, in view of the existence of an acceptable alternative route, the use of these two routes is disapproved.

The route designated "Tri-State /BCL Alternative Route " as proposed in your i.

August 30 letter, is judged to meet the regulatory requirements in accordance with 10 CFR Part 73.37 and accordingly is approved. This approval in no way i

attests to the traffic and highway safety of the route nor implies an flRC i

endorsement thereof from a traffic and highway safety standpoint. Also the approval does not guarantee that there will be no local or state leaislation aoplicable to the route that restricts or prohibits the movement of radioactive materials.

The initial arrangements with local law enforcement agencies along the route, as required by 10 CFR Part 73.37(a)(2), have been completed by the NRC staff.

I Data relating to these arrangements and a copy of the approved route are enclosed.

i This information is to be incorporated into your shipment plan and provided to j.;

your carrier along with instructions regarding its use.
