Dear Ms. Polasek-Rhodes:
Your letter of March 30, 1979 to the Environmental Drotection Agency, in which your express concerns about nuclear power, has been referred to this office for a reply.
You express concerns about the potential for hazards associated with the operation of the proposed Allens Creek fluclear Generating Station near Wallis, Texas, and ask that actions be taken to stop the building of the Allens Creek facility.
The Atomic Energy Act of 1954, as amended, provides for the licensing of nuclear reactor facilities such as Allens Creek. The Nuclear Regulatory Commission has the responsibility for issuing such licenses if it is determined that the facility will be constructed.in accordance with the Commission's regulations. Those rego-lations include regulations used to determine whether a proposed facility will meet the statutory requirements of the Atomic Energy Act and of the 1969 ilation.d Environmental Prot'ection Act.
Thus, neither the fluclear Regulatory Conriission nor the Environmental Protection Agency can arbitrarily stop the construction of a facility such as the Allens Creek facility, nor can either agency arbitrarily require that an alternate facility be considered.
The staff of the Nuclear Regulatory Conmission reviews the application. Upon a favorable conclusion of the staff, the Atomic Safety and Licensing Board will hold a hearing and determine whether the requirements for licensing have been satisfied. Upon issuance of a favorable Initial Cecision by that Board the Corm 11ssion's regulations would require that a construction permit be issued.
The applicant, the staff and the Hearing Board are required to consider measures to assure that there is no undue risk to the health and safety of the public and to evaluate the environmental effects of construction and operation of the pro-posed facility.
The staff's review of the Allens Creek application is essentially finished and the Hearing Board is proceeding with prehearing activities, including ruling en the admission of intervenors and contentions of intervenors.
