Pending Houston Lighting & Power Request for Expert Witness Materials
Dear Ms. Cyphert:
We still have not received the Department's supplementary response to Houston Lighting & Power's Interrogatory (2nd set)
No.
2, relating to expert witness testimony, workpapers and documents.
The deposition of the Department's chief economic witness, Dr. Gordon T.C. Taylor, is set for October 25, just ten days away, and the materials we have requested concerning Dr. Taylor are essential for the preparation of that deposition.
These material.' were first requested by Houston in Inter-rogatory No. 2 o f the "Second Set of Interrogatories and Requests for Production of Documents from Houston Lighting & Power Company to Antitrust Divisicn, U.S.
Department of Justice," dated February 9, 1978, to which the Department replied on April 3, 1979 in preliminary form (without providing any documents at all) and promised to supplement its response in the future.
In order to prepare for depositions Houston renewed its request for expert witness materials by letter dated June 25, 1979, and again renewed its request orally on September 17, 1979.
The Department has not responded.
With the near pendency of Dr. Taylor's deposition, we need all materials relating to him immediately.

I have been informed by Mr. Copeland that the Department wishes to inspect the expert witness materials of Houston's witness Abraham Gerber
- me York on Thursday, October 18.
It will not be possible ts inspect the documents that day; NERA'has just reo ganized its * :w York of fices and af ter these documents were produced to counsel for the NRC they were boxed up and relocated and are not yet readily accessible.
- However, it is anticipated that the documents can be made available on Monday, October 22.
Mr. Gerber's deposition, it must be noted, is a month away.
It seems only fair that before the Department embarks on a document review for that future deposition, it should ensure prompt and complete production of the materials Houston has requested for a deposition only ten days away.
I will be phoning you on these matters today so that we can expeditiously resolve them.

While our need for materials relating to the Department's other expert, Mr. Scott, is not as urgent, it would be appreciated if a supplemental answer relating to him could be provided promptly, so as to avoid recurrence of this problem.
