q' g cp NRC STAFF'S RESPONSE TO JUHN F. DOHERTY'S MOTION TO DISMIS5 OR POSTPONE APPLICANT'S CONSTRUCTION LICENSE APPLICATION The NRC Staff opposes the motion filed on October 4,1979, by John F. Doherty, an Intervenor in the captioned proceeding. Mr. Doherty seeks an order of this Boarc either dismissing the application for a construction permit or postponing this proceeding until the South lexas Project has been in full comercial operation for one year. Although Mr. Doherty lists four separate bases for the requested relief, the grounds for the motion are essentially:
(1) alleged quality assurance and technical qualifications problems at the South Texas site, and (2) the lack of any present need for the power to be generated from tne Allens Creek facility, which Mr. Doherty contends is being built, inter alia, to avoid interconnection with other utilities.
Pursuant to 10 CFR !i2.760, this Board will eventually 1ssue an initial decision in this matter in which it will make determinations with regard to all contested matters in this proceeding. The issues of technical qualifications and the

, need for power, specifically with regard to interconnection, have already been admitted as issues in controversy in the case. Therefore, these issues will be fully explored, and Mr. Doherty, as well as the other parties to the proceeding, will be afforded the opportunity to cross-examine both Applicant and Staff witnesses.
To the extent that Mr. Doherty believes that there is technical justification for the denial of this application, either for safety or environ &rb. reasons, his remedy now is the same as it has always been; namely, he may file contentions which delineate his concerns.
For the above reasons, the Staff believes that the instant motion is devcid of merit and should be denied.
