NRC STAFF RESPONSE TO MOTION FILED BY TdREE MILE ISLAND ALERT, INC.

TO MODIFY MEMORANDUM AND ORDER OF SEPTEMBER 21, 1979 On October 10, 1979, Three Mile Island Alert, Inc. (TMIA) submitted a " Motion to Modify Memorandum Setting Special creFearing Conference" (Motion), in which TMIA requests the Board to make certain amendments to the schedule proposed in the Memorandum and Order of September 21,1979 (Order).

TMIA asks the Board to modify the schedule set forth in the Order so as to postpone the date for filing draf t contentions, to require a special two-day conference for all the intervenors raising issues and contentions in this proceeding, and to require that copies of all petitions to intervene be served on all intervenors.

The Chesapeake Energy Alliance, Inc. (CEA) filed a motion on September 27, 1979, containing these same requests.

On October 15, 1979, the Licensing Board issued a Menorandum and Order in this proceeding, in which it denied the requested delay for filing draft

contentions and the mandatory conference among intervenors.

Accordingly, the Staff submits that these portions of TMIA's motion should be denied for the reasons set forth in the Memorandum and Order.

On October 19, 1979, the Board distributed a list of all petitions to inter-vene and submittals relating to contentions in this proceeding to all peti-tioners. Therefore, TMIA's third request has been granted and additional Board action is unnecessary.
