During the month of September, 1979, the City of Austin has not initiated any discovery requests.

The Department of Justice has requested that it change the date for looking at documents from October 5, 1979 to October 8, 1979.

Austin, as it has all along, will make its documents available at any time upon reasonable notice. Justice also has requested postponing the depositions of H. L. Peterson and Emmett Rummell, set for October 8.1979 and R. L. Hancock, set for October ' J, ,

1979, to November 1 and 2, 1979, respectively. Austin has not asked for any postponement. It has agreed to the change at Justice's request. Austin is opposed to any change that will result in the delay of discovery and ultimately the hearing itself. Austin desires that discovery and the hearing proceed as scheduled.
