This office has received a copy of your letter dated June 8,1979, which transmitted your Requalification Program for Licensed Operators of the General Electric Nuclear Test Reactor (License R-33) to the Office of Nuclear Reactor Regulation (0NRR). The transmittal was not accompanied by an amendment (approval) fee as required by Section 170.22 of 10 CFR 170.

It is our understanding that the ONRR staff will review your Program and issue a letter documenting their findings as to whether the Program is acceptable because it continues to meet the requirements of Appendix A of 10 CFR Part 55 and of 10 CFR Part 50.

Consequently, your June 8 filing is subject to the fee requirements of Part 170.

Reviews and approvals relating to a particular reactor facility should be classified in the same manner as applications for license amendments and fees determiiied and paid pursuant to Section 170.22 of Part 170.

Section170.12(c) requires that your Company provide a proposed determination of the amend-ment (approval) class, state the basis therefor, and submit the fee with your filing and/or amendment application.

Based on guidance from the ONRR staff as a result of preliminary review of your Program, it has been determined that your application falls in Class II ($600) because it is administrative in nature. You should forward the amendment fee promptly to this office.

Fees are payable to the U.S. Nuclear Regulatory Commission by check, draft, or money order.

If after the final evaluation of your application is completed it is determined that it was incorrectly classified, you will be billed for any additional amount due.
