Dear Chairman Miller and Members of the Board:
As the Licensing Board is aware, the Department of Water Resources and Southern California Edison Company have been negotiating an agreement re-garding the subpoena duces tecum directed to Edison.
By letter dated October 16, 1979, Counsel for DWR advised the Board that DWR and Edison had reached agreement and would soon be filing it with the Board and all parties. As indicated in that letter, the Staff has not been a party to those negotiations, is not a party to the agreement between DWR and Edison, and has not had an opportunity to review the final agreement.
Tile Staff will review the DWR-Edison agreement upon receipt and advise the
' Board as soon as possible thereafter as to whether the Staff will be satisfied with production from Edison pursuant to the agreement in lieu of the Licensing 830ard's January 25, 1979, Order, upheld by the Appeal Board in ALAB-550 on June 15, 1979.
