CEQ LETTER OF OCTOBER 29, 1979 We have reviewed the subject letter and would like to provide the following comments.

On June 23, 1978, Jane Mapes and Wayne Kerr met with Messrs. Jamieson and Lazarus of CEQ's Office of General Counsel to discuss CEQ concerns regarding the preparation of an EIS when a new State enters into an agreement with NRC. At that time we discussed the criteria used to evaluate State proposals and the CEQ representatives made recommendations regarding assessment of programs proposed by States desiring to enter into a Section 274 agreement.

When Rhode Island submitted a preposal Y7r an agreement, a staff assessment of the proposal was prepared which included a discussion of environmental radiation issues which we felt addressed CEQ's concerns.

On July 3,1979, we sent a copy of the Federal Register notice of the staff assessment to CEQ asking for their comments. We did not receive any response.

It is our feeling that we have tried to accommodate CEQ's concerns in our evaluation of the Rhode Island agreement. Their failure to provide specific comments on the staff assessment appears to support this.
